Triple murder by intoxicated ASI in Udaipur : DM Gomati submits Magistrate Level Enquiry report

UDAIPUR, July 29 (TIWN): DM Gomati Sonal Goel ultimately submitted the detailed report of the 19th July incident in which three persons were killed by an intoxicated policeman when he was driving the killer vehicle TR03-0986 early in the morning that resulted in outbreak of hatred against the police. Unable to control the unruly situation police charged lathis on all and sundry resulting to injuries on women, school and college students, aged people and businessmen. Under pressure from all concerned state govt ordered Magistrate Level Enquiry under Commission of Enquiry Act 1952 followed by CID Enquiry.

After going through all necessary steps the Enquiry Commission consisting of DM Gomati Sonal Goel, SDM Udaipur Ajit Debnath and DCM Sabyasachi Sinha completed the enquiry and submitted the report to the Chief Secretary S K Panda. On Monday DCM Sabyasachi Sinha went to Agartala to submit the Enquiry Commission's report to Chief Secretary. After getting the report from the DCM Chief Secretary S K Panda has sent an emergency message to DM Gomati in the afternoon and at 5.50pm DM Gomati Sonal Goel rushed to Agartala and according to a top level govt official Chief Secretary and DM Gomati held a long two hours closed door discussion on this report in presence of other top level administrative officials.

Though no one was available to make a statement on this report as it is very 'confidential', according to a TIWN source the Enquiry Commission's Report raised some serious allegations on the role of police and traffic police. On condition that the name of the official won't be revealed a top level official told TIWN correspondent on Monday night," The Commission has prepared a concrete and authenticated report revealing various aspects of the total incident. And if the Govt indeed acts based on this report, police will be in real danger.

But the way the case is handed over to CID in the middle of Magistrate Level Enquiry, there is considerable amount of doubt on the motive of state govt." According to TIWN sources the highlights of the reports are as follows:-

1) ASI Tapan Das of Radhakishorepur Police Station is the main culprit as he was driving the police vehicle (TR03-0986) on that fateful morning and he himself got injured was treated in GB Hospital

2) Driver Dilip Debbarma was sleeping in the back seat and he was intoxicated (medical reports too revealed this)

3) Both ASI Tapan Das and driver Dilip Debbarma appeared before the Enquiry Commission and recorded their statement. Dilip Debbarma told the Commission that he was not driving the vehicle but Tapan Das naturally denied his involvement just like a guilty usually does

4) Police initially reported that it was not police vehicle but DM and other members of the Enquiry Commission got the picture of the vehicle (TR03-0986) posted by many people in Facebook and it helped the Commission in proving the truth and on 19th July DM Gomati Sonal Goel sent this picture to Chief Secretary via e-mail along with the preliminary report of the incident

5) Ofiicer In charge Kanti Lal Baidya's false statement in public aggravated the total situation and encouraged the people turning mob

6) No attempt was made from the police to make an apology in public condemning the incident; rather SP Gomati Thirungana Sambandhana S instructed ON C Kanti Lal Baidya to remove the car from the place of accident in order to destroy evidence (ultimately this instigated the anger of the rank and file). SP Gomati was not seen to appear in public when the situation was going bad to worse

7) Police charged lathis twice (at 9.08am and at 10.13am) without being ordered by the Executive Magistrate; police not even used water cannon and no warning message was given by loud speakers cautioning the people about lathi charge

8) Police took no step from 4.20am on 19th July (time of accident) to 8.15am (first time people gheraod the Radhakishorepur Police Station)

According to a highly placed state level official," Commission has made every possible attempts to find out the truth and the real guilty behind this incident. The punishment should be given to the guilty and why should a man, who is not a guilty, be put behind the bars. The serious ground is the involvement of police in molesting the women as complained by them). Three persons were killed due to total negligence of Tapan Das, ASI and he should be treated as a guilty like a normal criminal. "The official also said that CID too is investigating the case and their report too will be vital.

However, he adds," If Chief Secretary and Home Ministry relies on Commission's report SP Gomati, O C R.K.Pur Police Station, ASI Tapan Das, driver Dilip Debbarma are in danger. Moreover, traffic police too are responsible behind peoples' anger because of recent hydra heads ISI marked helmet issues. The commission has done its job but we are left with no option but to wait for state govt's decision."
