AGARTALA, July 24 (TIWN): Just after Tripura High Court has posted state law secretary Datamohan Jamatia at Unakoti District as a District and Session Judge, the state government has been eyeing forward to get the law secretary service soon in view of the 10, 323 teachers’ case which is currently under the clasp of Supreme Court. However, Jamatia is scheduled to join on August 3 as posted by the HC. A contempt of court case against Jamatia was pending in the Supreme Court. Law Secretary who is scheduled to join Unakoti district and session court as a judge on August 3, was looking after various pending cases in the Supreme Court including the dismissal of 10,323 government teachers by an order on May 7 last year and upcoming elections to local bodies. Besides, according to the reliable official source the state government had stressed over the appointment of Unakoti District Session Judge Gautam Debnath as officer on special duty (OSD) in the high court, but interestingly at present Tripura HC has no existing post of OSD and has to be created by the state government to contain financial and other complications. A division bench of High Court of Tripura on April 29 this year has directed the framing of charges against State Law Secretary Data Mohan Jamatia under section 15 of Contempt of Courts Act for making a controversial remark on the judiciary.

However, following this Jamatia moving against the HC decision had filed a petition before the Supreme Court and denied making any derogatory remarks against the high court.

The HC removing Datamohan Jamatia from the law secretary post had also asked the Chief Secretary Yashpal Singh to induct a new law secretary.

It is worthy to be mentioned here that the removal of Jamatia from the law secretary post has left the state government in dilemma now as the government finds no alternative to the pending cases with the SC which were earlier handled by Jamatia.

Besides, another question triggered which indicates that, if Jamatia is back tracked, from join the new post being directed by the HC, then this would again bring another major problem for the state government.
