AGARTALA, Oct 25 (TIWN): Political and personal vendettas in Tripura Politics have hit the moral political ethics, increasing of personal attacks against opposition regardless age, seniority and experience of a person in opposition, resulting lost of humanity in ruling Govt politics, which wants to now drag a heart-attack patient under Police Custody. The urgency of fulfilling party's desire to take CPI-M MLA Badal Choudhury in Police custody proves the total case is a politically motivated case against Badal Choudhury which has no ground and will not help the BJP in legal run and future. However, after High Court delayed the hearing on Badal Choudhury’s case till 30th October but a showcasue notice was issued as to why Badal Choudhury should not get an immediate bail. Advocate General Arun Kanti Bhowmik after High Court allocated time to Govt side till 30th October to produce case-diary, said that once Badal Choudhury is discharged from the ILS hospital, then he will be produced before the Special Court for demanding police remand.

Addressing media, Badal Choudhury's Advocate Purushottom Roy Barman on yesterday after hearing at High Court said, “We were fully prepared for the hearing but the Govt side sought more time to produce case diary. On the basis of Advocate General’s plea, High Court has scheduled the next hearing on 30th October. Also the Court told the Govt that Badal Choudhury’s health should be taken care. So, on 30th October the hearing for bail-petition will be pronounced”.

“We were ready for the hearing, but as the Govt side sought time, so the Court has allocated more time”, said Purushottom Roy Barman.

On being asked by media if Badal Choudhury is being arrested on that time Purushottom Roy Barman said, “Govt side claimed Badal Choudhury is already arrested and he was arrested in ICU and right now arrested in the hospital only, but now in addition court has instructed Govt to take care of Badal Choudhury’s health”.

Media persons further asked, if Badal Chouhdury is produced in the court then what will be done ? Purushottom Roy Barman said in reply, “Court has given permission that if anything emergency happens then we can come to the court”.

On the other side, Attorney General Arun Bhowmik said if Badal Choudhury is discharged by ILS hospital, then he will be produced before the Special Court and Govt side will seek Police remand for him. Not only this, Bhowmik also accused Badal Choudhury saying "He was roaming absconding", whereas Badal Choudhury's advocates earlier stated "absconding" word comes when arrest warrant is issued.

Political Egoes have gripped minds so much that BJP top leaders are not believing infact about Badal Choudhury's heart-attack incident although the Govt Doctors after checking Badal Choudhury at ILS hospital confirmed on October 23 that Badal Choudhury has really suffered from 2 mild-strokes.

 High Court Issued Show-Cause upon the State Govt

The High Court of Tripura led by Justice Arindam Lodh on yesterday issued a notice to show cause upon the State Government as to why the plea of bail of Badal Chowdhury should not be allowed and differed the hearing.

While hearing P Roy Barman and T.D. Majumder, Counsels on behalf of Chowdhury strongly urged for interim bail as he is seriously ill and suffering from cardiac ailments and admitted to the ILS Hospital for which he may not be able to face/attend the custodial interrogation.On the other hand the Advocate General A.K. Bhowmik submits to issue notice upon the State-respondent and also urged to fix the date on 30.10.2019 for production of the case diary. Thereafter the bench issued show-cause notice upon the State-respondent as under “Accordingly, issue notice calling upon the State-respondent to show-cause as to why the bail the application shall not be allowed, as prayed for; and/or why such further and other order(s) shall o be passed as to this Court may deem fir and proper”.

That, earlier ex-PWD Minister, Badal Chowdhury was booked u/s 401, 420, 418, 102 and 120B of the Indian Penal Code and u/s 13 of The Prevention of Corruption Act, along with ex-chief engineer Sunil Bhowmik and the then Principal Secretary Y.P. Sing on alleged fraud on various PWD work contracts.

Though earlier an interim relief was granted to Mr Chowdhury on 14.10.2019 by the Special Judge, West Tripura but finally on 16.10.2019 the Special Judge aka Session Court, West Tripura rejected the plea of the anticipatory bail of the Former PWD Minister Sri Badal Chowdhury. Thereafter, Mr Chowdhury approached the High Court Tripura for pre-arrest bail but as he was alleged to be arrested on 21.10.2019 at about 9.30 PM at ILS Hospital, the Single bench of High court of Tripura, comprised of Justice Lodh dismissed the matter as anfractuous on 22.10.2019.

That on the same day Namita Gope filed a petition for bail u/s 439 on behalf of Mr Chowdhury, which was registered as BA 134 of 2019 and was fixed for hearing today as in continuation of the earlier anticipatory bail which was dismissed as anfractuous on 22.10.2019.   

 Advocate General Arun Kanti Bhowmik and P.P. Ratan Datta appeared for the State-respondent while P. Roy Barman, Advocate and T.D. Majumder, Advocate appeared for Badal Chowdhury.
