SC's order clearly shows the incompetency of Manik-Tapan ; State Govt playing nasty politics with minds of the 10323 teachers ? Terminated teachers gearing up to file case against state gov't ?

AGARTALA, Oct 7 (TIWN): The incompetency of Manik Sarkar led LF Govt and Tapan Chakraborty led School Education Department has once again brought shame to the state govt as the Apex Court issued a stay order in the recruitment process of 12000 mysterious non-teaching posts .On 4th October the Supreme Court restrained the state govt from filling up these non-teaching posts . Hearing on the Contempt of Court case filed by Debashish Pal Chowdhury the Apex Court categorically stated that the prima facie merit in the allegations in the contempt petition has been found . It is to be noticed here that on 11th September 2017 the Division Bench of the Apex Court comprising Justice Adarsh Kumar Goel and Justice UdayUmeshLalit issued returnable notice to the Chief Secretary Sanjeev Ranjan , Principal Secretary , Education Department Sushil Kumar and Addl Secretary , School Education Department NirmalAdhikari . The Apex Court issued this notice on hearing the CONMT.PET(C) No 1706/2017 in the SLP(C) No 18993-19049/2014 filed by Debashish Pal Chowdhury for Admission and IA No 85160/2017(CLARIFICATION/DIRECTION) .

After the submission of the returnable notice the Apex Court made the following order on 4th October during the hearing :-

"We find prima facie merit in the allegations in the contemptpetition and prayer for initiating proceedings against therespondents. Learned counsel for the respondents seeks further time

to make submissions.

Adjourned to 24th October, 2017.

 Personal appearance of thealleged contemnors is dispensed with till further orders.

 Libertyto file any further affidavit.Pending further consideration,

the State of Tripura isrestrained from filling up the posts of newly recruited 12,000

posts of Student Counsellor, School Library Assistant, Academic

Counsellor, Hostel Warden and School Assistant. "

It is to be mentioned here that on 29th March 2017 cancelling the SLP No 21249/2014 in State of Tripura & ORS versus TanmayNath& ORS the Apex Court upheld the High Court's verdict given on 7th May 2010 terminating the 10323 teachers - Post Graduate , Graduate and Under Graduate respectively . In that order the Division bench of the SC comprising Justice Adarsh Kumar Goel and UdayUmeshLalitcategoricaly stated ," 10323 teachers can remain in service upto 31st December 2017 . By this time the state govt has to frame fresh employment policy and initiate process to recruit them , who have requisite qualifications as specified in the NCTE guidelines . "

But violating the SCs order state govt led by Manik Sarkar started paying nasty politics with the 10323 terminated teachers and created 12000 mysterious Non-teaching posts to rehabilitate these terminated teachers through back door . Quite surprisingly , state govt made a mandatory teaching experience of three and five years respectively for these non-teaching posts. This means that all these posts were created simply to recruit the 10323 terminated teachers in an arrogant attempt of befooling the judiciary .

From the very beginning questions were raised about the validity of such mysterious . Several questions were raised against  state govt:-

1)How far the teaching tenure of teachers , whose jobs itself were terminated by the HC followed by the SC , be treated as service experience ?

2)Isn't it illegal to make teaching experience mandatory for non-teaching posts ?

3)How can the employees, who are now getting regular pay scale , be illegible to apply for posts of the same rank but on fixed-pay basis ?

4)Why didn't the state gov't follow the order of the Supreme Court  issued on 29th March .

 

Legal experts opine that state govt knew that these posts will be challenged in the Supreme Court but it remained firm in its decision simply for nasty politics with an attempt to hang lollypop before these 10323 teachers ahead of Assembly Poll 2018  .

Meanwhile , in a recent development 10323 terminated teachers are learnt to be gearing up for filing Defamation charges along with compensation demand against the state govt . TIWN sources confirmed that on 5th October(Thursday) 10323 terminated teachers held sub-division wise meeting among themselves . In this meeting a decision to file compensation charges against the state govt was unanimously taken . Soon the teachers will meet at Agartala to take final decision on this issue, the sources added . If such a step is taken , it will be a terrible blow to the state govt .
