SC order violation : 'Can 10,323 Teachers scam send Manik Sarkar to jail?', Haryana CM Om Prakash Chautala’s 10 years jail after illegally recruiting 3,206 junior basic teachers !

AGARTALA, Sep 15 (TIWN): Supreme Court’s order violation and subsequent tight slap by Apex Court is an indication that Chief Minister Manik Sarkar’s future jail term imminent as mighty Chief Minister Chauthala was jailed for a mere 3206 junior teachers recruitment scam. Manik Sarkar’s corrupt Govt responsible for multiple mega-size recruitment scams in every department causing huge losses to Central Govt as well as deceiving hapless unemployed graduates. Not only that Manik Govt collected forced donations from 10323 teachers to fight their case in SC but Supreme Court passed verdict on March 29,2017 against State Govt for irregularities & corruption. It’s worthy to mention that The INLD supremo Om Prakash Chautala and his son Ajay Chautala were convicted on January 16, 2013, by a Delhi court for illegally recruiting 3,206 junior basic teachers 12 years ago.

Indian National Lok Dal (INLD) chief and five-time Haryana chief minister Om Prakash Chautala and his son Ajay Chautala were sentenced to 10 years in prison after being found guilty of corruption in a teacher recruitment scam on January 22, 2013.

In Tripura’s case the recruited teachers’ number are 3 times more than the Haryana case. Now if like earlier, any opposition party, files case in Court appealing Manik Sarkar’s corruption in his long chief minister’s regime then what will happen next…? It’s to be seenHowever, 10,323 case lost one the one hand have although devastated the families and also CPI-M comrades, on the other hand the verdict has cheered the oppositions in Tripura and celebrations are going on across the party offices in whole state, except CPI-M party offices. 

Supreme Court has served notice to the Govt of Tripura regarding the violation of SCs order given on 29th March 2017 in the 10323 terminated teachers' jobs . On 11th September the Supreme Court Division Bench comprising Justice Adarsh Kumar Goel and Justice Uday Umesh Lalit , on heraing the CONMT.PET(C) No1706/2017 in SLP (C) No 18993-19049/2014 For Admission and IA No 85160/2017(CLARIFICATION/DIRECTION) issues notice to three top level officials namely :

  1. Sanjeev Ranjan , IAS , Chief Secretary , Govt of Tripura
  2. Sushil Kumar ,IAS , Principal Secretary to the Govt of Tripura, Education Department
  3. Nirmal Adhikari , Addl Secretary to the Govt of Tripura , Education Department(School) .

In its order given on 11/09/2017 the Division Bench of the Supreme Court categorically said :-

" The petition was called for hearing today".

Since it is stated that certain steps are being taken in violation of this Court's order dated 29/03/2017 issue notice returnable within two weeks. "

      The petitioners in the case are Debashish Pal Chowdhury & ORS 

    It is to be mentioned here that in its order in 10323 terminated teachers' jobs  given on 29th March 2017 on hearing against SLP No 21249/2014 in State of Tripura & ORS versus Tanmay Nath & ORS the Division Bench of the Supreme Court comprising Justice  Adarsh Kumar Goel and Uday Umesh Lalit mentioned the following vital points :-

  1. New Employment Policy should be framed by the Stateby 30th April 2017 if not already framed and advertisements for filling up the vacancies may be issued latest by 31st May 2017 .
  2. The fresh selection process be completed on or before 31st December 2017 and till fresh process is completed , the teachers already appointed shall continue
  3. The candidates, who participated in the selection process pursuant to the advertisements in question, whether selected or not will beallowed to participate in thefresh selection process by relaxing their age but subject to their having necessary qualifications
  4. The qualifications of teachers employed for Class -IX and above shall be strictly in compliance with the relevant provisions concerning such appointments ."

A division bench of the high court, comprising Chief Justice Deepak Gupta and Justice Swapan Chandra Das, had passed then order May 7, 2014 terminating the jobs of 10,323 school teachers after Dec 31, citing irregularities in recruitment and SC has upheld High Court's 2014 verdict.

Supreme Court in a humanaitarian gesture to 10323 teachers mentioned that the teachers will continue their jobs till 2017, 31st Dec. But the recruitment process must be started within May 31st and to be completed within Dec 31st, Law Secretary Datamohon Jamatia said. However, DataMohan also mentioned that state govt will reappeal  to the Central Govt for them who have not completed B.Ed degrees. 

Under CPI-M Era, Job recruitment, Promotion have become contradictory & the Tripura government has been opposing the setting up of the school service commission and Teacher's Eligibility Test (TET). But, after Central's pressure TET was launched in Tripura, job-appointment corruption turned more deep-rooted.

From Firemen job to TBSE, in every sectors youths started to questioning about Job appointment. Under Tripura Govt. while appointing someone in a post for Govt. employee no rule is followed, which was proven when Tripura High Court as well as Supreme Court canceled in total 10,323 teachers job, finding massive corruption held under Tripura Education dept, while recruiting someone in job.

Resentment has been brewing among the devastated families, as Tripura Govt has not though about any alternative job for them.

Question raises......

Who is responsible for this day ? 

Who will punish actual culprits from Chief Minister, Education Minister to former Chief Secretary S.K.Panda and former Education Secretary Banamali Sinha for appointing 10323 teachers illegally to benefit CPI-M party ?

Supreme Court's order to State Govt for replying show-cause notice on Supreme Court's earlier order violation may cost Manik Govt dearly as SC might ask CBI to start an independent investigation into CPI-M Govt's various scams.
