Court relieves a convict with little fines, after 4 years delay

UDAIPUR, August 6 (TIWN): Accident cases seem very prominent issue in the state, which cause by transport system’s problems, as well as careless attitude of the drivers here. On August 5, JM 2nd Class, Court No-2 of Udaipur Gomati Dist has convicted an accused namely Sukesh Majumder and punished him with Rs. 5,000/-, for causing injuries to a 19 years boy due to his reckless driving in the year 2011.

In the year 2011, month of August the victim namely Rahul Debnath (19) had been brutally injured followed by the reckless driving ofSukesh Majumdar (47). The event took place on August 22, 2011 when Sukesh Majumdar (47), S/O: Lt. Aswini Majumdar , resident of Badharghat PS Amtali had driven Rahul critically injured, by striking him with his jeep fueling into high speed. The incident took place at Udaipur Town to Chandrapur Colony at near colony Bazar NH-44, under R.K.Pur PS.

Accordingly a case had been registered on that very day, i.e. on August 22, 2011 on the basis of the complaint of the victim’s father Sri Pradip Debnath, with the case number Case No. 379/2011 PS U/S- 279/338 IPC.

However, after investigation I.O of the case SI Manik Lal Nandi filed Charge-sheet on 21-11-2011 vide R.K.Pur PS C/S No. 448/2011 U/S 279/338 IPC against the driver of offending vehicle namely Sukesh Majumdar (47) S/o Lt. Aswini Majumdar of Badharghat PS Amtali. Dist-West.

 

Both the 279 and 388 IPC had been charged by the investigator Manik Lal Nandi against the accused one.

According to IPC 279, whoever drives any vehicle, or rides, on any public way in a manner so rash or negligent as to endanger human life, or to be likely to cause hurt or injury to any other person, shall be punished with im­prisonment of either description for a term which may extend to six months, or with fine which may extend to one thousand rupees, or with both.

 IPC 388 is for whoever commits extor­tion by putting any person in fear of an accusation against that person or any other, of having committed or attempted to commit any offence punishable with death, or with 1[imprisonment for life], or with imprisonment for a term which may extend to ten years.

 After 4 years when the court convicted Sukesh Majumder as guilty, sentenced him only with Rs. 5,000/- fine. It’s to be mentioned here that on 05-08-2015 Ld. J.M 2nd Class, Court No- 02 Udaipur,Gomati District has convicted one Sukesh Majumdar (47) S/o Lt. Aswini Majumdar of Badharghat PS Amtali. Dist-West U/S 279/338 IPC.
