10,323 teachers termination case: Next hearing date April 6: Fate of the teachers under deep suspense

AGARTALA, January 28 (TIWN): The next calendar date for the hearing of 10,323 teachers termination case is scheduled on April 6 at the Supreme Court; uncertainty still prevails over the fate of the terminated teachers. As per scheduled programme, the case was placed in the registrar’s bench of the Apex Court. After, the cross checks of various documents, it was found that most of the members of both defence and Government sides did not get notice till date, said Law Secretary Data Mohan Jamatia over telephone today. Therefore the Court has declared the next date for hearing on April 6. In the meantime all notices should be sent and the members can send their queries and reply, Jamatia further added.Earlier, after first hearing in the month of August, the case was again placed in the Court for hearing today, though no satisfactory result was announced and anxiety still prevails among the 10,323 teachers.

Registrar of Supreme Court conducted a preliminary hearing in October this year and admitted the case for further hearing. And accordingly the court conducted the second hearing on December 8, allowed them to continue beyond Dec 31 and until the final disposal of the case.

It is to be mentioned here that the Supreme Court in the year 2009, issued a notification that in case of appointment of teachers, new education policy should be implemented. As per the notification, Central Government had instructed the State Government to take this policy in action. But the State Government of Tripura turned a deaf ear to this and still no education policy was implemented.

Uncertainty still prevails over the 10,323 teachers’ termination case... The teachers were feeling anxious of their future. Whether the Honorable Supreme Court will deliver the judgment in their favour or against are the top most burning questions among all the sections of people. The question arises in the present moment are

1) Why did the govt take refuge in lies from the very beginning?

2) Has the govt got hint from legal experts that it will lose the case in the SC?

3) Is the Inter Locator appeal another attempt to be fooling the people?

4) If the hearing on Interlocutory Application date too is finalized after 31st December what will be the govt's step?

5) Is the govt worried after it learnt that the case will be dealt with Avisekh Many Singbhi and in that case will it be defeat awaiting situation?

It is to be mentioned here that the High Court of Tripura on seventh May issued an order for the termination of services of 10,323 teachers as the State government does not follow the justified process for their selection... After that the Government appealed to the Supreme Court to take proper action in the termination issue of the teachers. On the other hand - A section of the job aspirants among 10,323 teachers will file a criminal case against the State Government. A highly informed source states that, if State Government failed to win the 10,323 teacher termination case in the Supreme Court, most of the teachers will file case against the Government.

It is to be mentioned here that the Supreme Court in the year 2009, issued a notification that in case of appointment of teachers new education policy should be implemented. As per the notification, Central Government had instructed the State Governments to take this policy in action. But the State Government of Tripura turned a deaf ear to this and still no education policy was implemented. On the other hand the job form for the interview of the undergraduate, graduate and post graduate teachers are called in the year 2002, 2003 and 2006. But the candidates are called for interview in between the year 2010-2013. During this gap, State Government if wished could have implemented the policy. But travelling here and there, no action had been taken. Inspite of that, on a sudden decision, in the year 2013 on Christmas Day, the Cabinet decided to appoint 10,323 teachers in undergraduate, graduate and post graduate level.
