10,323 teacher termination case on Supreme Court tomorrow: Will SC hear or reschedule case again ? Repeated postponing causing havocs

AGARTALA January 27 (TIWN): The latest date for hearing of the 10,323 teacher termination case is scheduled for tomorrow January 28th. Most important question among the sections of people is that during latest few schedules dates of hearing, it was not possible to place the case in front of the Supreme Court. Will history repeats itself or something miracle will happen and case will be heard tomorrow?

Earlier, Hearing of the 10,323 teacher termination case had again postponed on January 15th due to some administrative work. However,repeated delays of hearing of this important case had created tension among the 10323 sacked teachers. It is to be mentioned here that after the date of first day hearing, the other tentative dates are postponed every time. In the meantime, Supreme Court has been hearing the case following the interlocutory application filed by the Tripura Govt. challenging the High Court’s verdict.

During the month of December 2014 the SC stayed the HC order to terminate the jobs of at least 10, 323 teachers and allowed them to continue their service until the final disposal of the case. Supreme Court was supposed to hear the interlocutory application on January 9, filed by the Tripura Govt. to save the terminated jobs of at least 10, 323 Graduate, Under Graduate and Postgraduate teachers .Registrar of Supreme Court conducted a preliminary hearing in October this year and admitted the case for further hearing. And accordingly the court conducted the second hearing on December 8, allowed them to continue beyond Dec 31 and until the final disposal of the case.  It is to be mentioned here that the Supreme Court in the year 2009, issued a notification that in case of appointment of teachers new education policy should be implemented. As per the notification, Central Government had instructed the State Governments to take this policy in action. But the State Government of Tripura turned a deaf ear to this and still no education policy was implemented.

However, Anxiety prevails among the 10,323 teachers as State Government pays rapid attention for the introduction of TET to appoint teachers, by neglecting the teacher termination case. On the other hand, Government has violated all rules and regulations by issuing the notification on TET at Cabinet meeting. As once a decision after being amended by Parliament, cannot be changed by any State Governments. But the State Government on a cabinet decision decides for the application of TET, though all rules and regulation falls under the tenure of Central Government.

Now job seekers too have realized that the Supreme Court has issued a stay order only on the govt's recruitment policy that was declared unconstitutional by the Division bench of High Court. They have now also realized that in the name of challenging the case in the Supreme Court, CPI (M)'employees wings rather raised the party fund with approx Rs 6 to 8 crores by collecting donations from those 10323 teachers whose jobs were terminated and other Govt employees. . All are scared that if the Supreme Court says that the HCs judgment will remain unchanged; There will be serious breakdown among the aspirants as well as in the law and order situation.10, 323 aspirants, now feels the anxiety that the State Government in the recent time, by spending less time on securing their future and wants to save their side by issuing the TET.
