AGARTALA, December 15 (TIWN): Ever since the case of the SC/ST promotion case was raised before the full bench of the HC for hearing, two names doing circles are Law Secretary D M Jamatia and the Deputy Secretary Sarbari Das. But as soon as the file note of the Law Secretary D M Jamatia got leaked in media all eyes are on him. Quite surprisingly inspite of using some words crossing the limit of his post, Data Mohan Jamatia succeeded to get CM’s approval for wasting Rs 25 lakh simply to save his own service on conviction from the High Court. And that very note itself is a proof against Data Mohan to be charged with 'Contempt of Court' for using demeaning language against Hon. Chief Justice of Tripura High Court.But quite interestingly how can the Chief Minister Manik Sarkar approve such a file that involves a huge waste of govt money which is collected from the honest and responsible citizens of the state?

 What made him so hurry to approve the file on that very date (24/22/2014)on which it was sent to him for approval? By his approval Chief Minister Manik Sarkar has himself raised the doubt in the mind of the people. Will he agree to approve such file that too may involve huge expenditure like the one in D M Jamatia'as case? Will the state govt follow the same policy to protect other corrupt officials like BDO Bimal Chkraborty by appointing advocates from Delhi and that too on Govt cost?

Chief Minister has extraordinary faith on the Law Secretary of the concerned state. TRIPURAINFOWAY.com cannot question the ground?

But in this particular case TRIPURAINFOWAY.com wants the state govt to clarify some crucial points:

1) Is Chief Minister Manik Sarkar not aware of the fees that an advocate even as a Solicitor General can get for giving legal advise?

2) Was D M Jamatia misguided Manik Sarkar regarding the overall expenditure ?

3) Why didn't the CM consult with other legal experts before approval such a crucial file note?

4) What actually prompted the CM to approve such a file on the same day on which it was sent to him?

5) Is D M Jamati so faithful to Manik Sarkar that he has to approve any file without any day once it is sent from the current Law Secretary?

6) How can a Chief Minister, who invariably asks the officials to cut expenses as far possible, become so lenient in case of his 'favoured' Law Secretary?

7) Why didn't the CM not attract the Law Secretary's attention regarding the humiliating and unconstitutional words against the Judiciary like the Chief Justice of the High Court and that too in such a case which is yet to be finalized?

8) Is Manik Sarkar himself instructed Law Secretary to draft such a file to put pressure on the HC before the final verdict is given?

9) Why didn't the CM ask the Law Secretary for giving false explanation to the state govt regarding the Stay Order given by the Division Bench of the Guwahati High Court in 2005 ?

 It is really very surprising to note that a state govt and its Chief Minister Manik Sarkar agreed to fight in favour of a 'guilty Law Secretary ' spending Rs 25 lakh from state fund.

Actually only a few knows that CM Manik Sarkar and Law Secretary D M Jmatia are closely linked and when Manik and Datamohan were studying in Udaipur Ramesh H S School, both were promising figures of SFI. And it was Manik Sarkar , under whose instructions D M Jamatia was appointed as Law Secretary. But Manik Sarkar is too blind towards Data Mohan that he is even ready to forgive him even if he creates an awkward situation. What is striking is that when the daily fees of the Solicitor General , his deputy along with two helpers can get Rs 10 lakh( including TA/DA and travel and lodging expenses outside Delhi, D M Jmatia befooled CM Manik Sarkar by getting approval Rs 25 lakh. Who will get the rest Rs 15 lakh? Well its a million dollar question.

      Moreover, from his note it is quite evident that Jamatia intentionally tried to put pressure on the High Court in the Contempt of Court case. Some senior advocates opine that the very words," .. ... but the High Court of Tripura, with preconceived mood... ...", " We are afraid whether the High Court will damage our service records or career ," and "The Chief Justice  is trying to demoralize us so that no views can be given against any order of the High Court" are enough to invite Contempt of Court against Datamohan.

 Now all eyes are on the High Court even before the Hearing likely to be done on 17th December. Legal experts too are eager to know:

1) Whether the Chief Justice asks clarification from Data Mohan Jamatia ?

2) Whether High Court will charge another case of Contempt of Court?

3) Whether the HC will hold Law Secretary and his deputy as guilty?

4) Whether the HC verdict will make a constitutional crisis in the state as the note of Law Secretary is an indication that the state govt too wants to start a tussle with the HC.

5) Whether Data Mohan will be removed from his post before the actual hearing ?

6) Whether state govt satisfies the court can process of the hearing.
