AGARTALA, June 5 (TIWN): The Former CPIM MLA Bhanulal Saha was called to the East PS over a “Right to self-defense†post on social media.
After facing the preliminary interrogation with his lawyer, Adv Bhaskar Debbarma, the leader said,” the ruling party is allegedly continuing its violent attacks on our party leaders and activists in a brutal manner. I was also physically assaulted by some miscreants before. An innumerable number of complaints have been lodged in the police stations but since the administration always plays a blind role, I wanted to make the people aware of the Right to self-defense through my Facebook post. Reacting to that a BJP activist named, Ashim Bandhopadhyay registered a case against me.”
“BJP, IPFT and Tipra Motha, all the three parties are ruling our state now and on my post, I did not mention any of the party’s name yet the BJP stepped forward to file a case against me which clearly proves who is responsible for all the violent attacks taking place ruining the peace and harmony of the state”, the leader added.
However, the Indian Penal Code perceives an individual‟s right to secure body and property of himself and any other individual against a looming risk when the state help can't be received and in this manner gives the right of Private Defence to ensure them under Section 96 to Section 106 of the Indian Penal Code. The privilege of private defense is a significant right and it is essentially preventive in nature and not punitive. The privilege may be practiced against all offenses influencing the human body or endeavor or sensible danger of the commission of any such offense or offense of burglary, theft, mischief, or criminal trespass and endeavors to carry out any of such offenses in connection to the property.
