Tripura High Court Quashed illegal Look out Circular (LoC) against US based Tripura News Media Editor : Directs State Govt not to take any such attempt in Future without Court's Permission

AGARTALA, March 16 (TIWN): In a landmark verdict, Tripura High Court has not only quashed Look out Circular (LoC) against TIWN Editor, but also restricted the State Govt from such illegal acts without Court's permission. High Court also mentioned about the nature of the crime allegation and hypothetical allegations, actions of the State Govt are violation to personal liberty. Addressing media, Advocate Amitabha Roy Barman has thanked Judiciary for upholding the freedom of speech and personal liberty. "It appears from the nature of allegations that it is not a case of extortion but an „attempt? which may not fall within the serious crime. Moreover, the respondents No.1 and 2 did not produce the case diary to support their case of serious fraud or commission", High Court stated in the final order. High Court Advocate Amitabha Roy Barman further criticized Tripura Govt's motivated, illegal actions against TIWN Editor based on a petty case which was filed by a Hardcore-Criminal who was arrested many times by Tripura Police.

'Mere allegation cannot form antecedent.........', said High Court 

Announcing the news, Tripurainfoway.com (TIWN) Editor Saumen Sarkar said, "Since year 2018's October month, there have massive intimidations against me by Biplab Deb Govt. Even my 75 to 80 years old parents were harassed through police machinery.  In 2019, the then SP Ajit Pratap Singh and Biplab Deb's chief advisor OSD Dilip Roy managed to issue Look out Circular notice against me in all Indian Airports, so that I can be arrested immediately after landing in India".

"But today finally, Tripura High Court not only quashed LoC against me but also has given warning to the State Govt. To destroy the democracy and to curtail the freedom of speech what has not the Govt done ?? But this corrupt machinery might had forgotten that "Satyameva Jayate" and Truth always wins ! I won because, I was on the path of Truth", said TIWN Editor. 

Briefing media at Tripura High Court, Adv Amitbha Roy Barman said that all these cases filed against Saumen Sarkar are motivated which have "no ground". 

High Court also asked Tripura Govt to withdraw LoC within 24 hours.

Honourable High Court has quoted, "This court cannot shut its eyes to the right of the petitioner. The action which curtails or takes away the personnel liberty has to be reasonable and proportionate and has to be considered not in the abstract or hypothetical considerations".

Biplab Deb also tried his best to cancel the passport of the TIWN Editor. Observing all the matters, the Court has said, "Having regard to all these aspects as recorded above, the lookout circulars as issued against the petitioner stands quashed..........there is no contemplation of impounding of the passport by way of overstepping the authority, it is directed that without the order of the competent criminal court, the investigating agency shall not venture for taking action for impounding the passport of the petitioner as coercive measure........the writ petition stands allowed".
