Hearing of the Interlocutory application: Tenure of 10,323 teachers will continue till further order: Supreme Court; Next hearing  on 9th January,2015

NEW DELHI / AGARTALA, December 8 (TIWN): The job of the 10,323 teachers will continue till further order. A division bench of the Supreme Court comprising Justice Jagdish Singh Khehar and Justice Arun Mishra passed an order allowing the continuation in service of all the 10,323 teachers till the final disposal of the case or until further orders. Supreme Court on Monday had passed the order on the hearing of the interlocutory application filed by Tripura Govt. that on 31st December the fate of the teachers will not come to an end. This is certainly a temporary sigh of relief for the 10,323 teachers for a limited period. It is to be mentioned here that the next hearing of the case filed by the State Government to save the fate of 10,323 teachers was scheduled on 9th January 2015.Though it had caused relief to the teachers, but the final decision is a long way to come. A highly informed source stated that, if State Government fails to win the 10,323 teacher termination case in the Supreme Court, most of the disgruntled teachers will file criminal case against the Manik Sarkar's Government.

School Education Department suffered a major jolt as Registrar of the Supreme Court declared on Oct 27 that the 'Hearing on the Teachers Recruitment Rules of the state' govt will be held on 9th January 2015 which was declared 'Unconstitutional' on May 7 by the Division Bench of High Court headed by Chief Justice Deepak KumarGupta and Justice Swapan Ch Das.

It is to be mentioned here that the High Court of Tripura on May 7 issued an order for the termination of services of 10, 323 teachers as the State government did not follow the justified process for their selection... After that the Government appealed to Supreme Court to put a stay order on High Court’s judgement. On the other hand, a section of the job aspirants among 10,323 teachers will file a criminal case against the State Government.

It is to be mentioned here that the Supreme Court in the year 2009, issued a notification that in case of appointment of teachers new education policy should be followed. As per the notification, Central Government had instructed the State Governments to take this policy in action. But the State Government of Tripura turned a deaf ear to this to accommodate CPIM party cadres and still no education policy was implemented. On the other hand the job form for the interview of the undergraduate, graduate and post graduate teachers are called in the year2002, 2003 and 2006. But the candidates are called for interview in between the year 2010­2013.During this gap, State Government if wishes can implement the policy. But travelling hither and there, no action had been taken.Inspite of that on a sudden decision, in the year 2013 on Christmas Day, the Cabinet decided to appoint10, 323 teachers in undergraduate, graduate and post graduate level.
