After SC notice in 10323 terminated teachers' recruitment process in Non-Teaching posts CPI-M blaming BJP & Deodhar ; Is CPI-M worried about its unethical attempt violating SC order ?

AGARTALA , Sep 20 (TIWN): Ever since the Supreme Court of India sent returnable notice to Sanjeev Rajnjan , Chief Secretary , Sushil Kumar, Principal Secretary of Education Department and NirmalAdhikari, Addl Secretary of School Education Department , ruling CPI-M has started to politicalize the issue blaming BJP and its Observer Sunil Deodhar in an heinous attempt of playing with the minds of 10323 teachers' simply for political Following is the details of information (note) sent to New Delhi by the BJP Spokesman Dr Ashok Sinha : 1. Background: The Government of Tripura, as a matter of policy desisted from appointing any teachers in the Primary schools for 18 years since 1992.

The Government made a show of advertising and taking interviews, three times, in 2002, 2006 and 2009, never ultimately appointing anyone. The process was used as a lure for young unemployed youths to be close to CPIM. 

However, in 2013, few  years after  RTE Act, nearly Ten Thousand jobs were offered and the candidates joined. Similarly in the High Schools and Higher Secondary Schools, appointments were made. 

The method of selection was arbitrary and therefore some deprived candidates approached the Hon’ble High Court of Tripura. The Hon’ble High Court cancelled the appointments of 10323 teachers and gave suitable orders for fresh appointments. However the case ultimately reached the Hon’ble Supreme Court.

2. The Supreme Court Order: On  29/03/2017 the Hon’ble Supreme Court ordered that

Since we do not find any grounds to interfere with the impugned order, the directions in Para 123 need now to be suitably modified. We, therefore Direct:

(a) New Employment policy should be framed by the state by 30th April 2017, if not already framed and advertisement for filling up the vacancies may be issued latest by 31st May 2017.

(b) The fresh selection process to be completed on or before 31st December 2017 and till the fresh process is completed, the teachers already appointed shall continue.

(c) The candidates who participated in the selection process pursuant to the advertisements in question, whether selected or not, will be allowed to participate in the fresh selection process  by relaxing their age but subject to their  having necessary qualifications.”

3. Tripura CPIM Reaction: The CPIM Tripura called this judgment “Inhuman” and even raised doubts about “RSS and BJP influencing the Supreme Court”. The Left Front Government openly declared support for the people who lost their jobs.

4. The State Government actions : The order of the Court was clear enough, but the state Government ignored everything ordered by the court and went on to declare that 13000 new jobs would be created in such a manner that only those who lost their jobs due to the Supreme Court order would be  eligible to apply. This is a clear disregard of the Supreme Court order. The new posts are such that never existed anywhere and has no practical utility. What’s more, the qualifications and experience desired by the Govt for being eligible to these posts are astoundingly similar to those who lost their jobs. The idea is loud and clear, these jobs were created to accommodate the favorites.

5. What are the new jobs created?

a) 5600 posts of School Assistants for Madhyamik and 3 years experience in Teaching in Government schools.  That’s the number of Madhyamik pass candidates who lost their jobs too.

b) Rest of the Posts of Academic Counselor, Student Counselor, Hostel Wardens, Library Assistant are similarly aimed at rehabilitating the individuals who lost their jobs.

6. The disregard of Courts Order: As per the Courts order, the state government was supposed to frame new employment policy by 30th April, 2017, not done yet. Advertisements for new posts, not done yet.

7. What’s more,  The CPIM led government is trying to bypass the orders by trying to influence officers in the Ministry of Education so that no reaction comes from the Ministry in New Delhi.

8. The Reaction of the CPIM  It was downright contempt of court when the CPIM Spokesperson declared on camera that there was doubtful link between the Supreme Court and the BJP and RSS because the courts order, according to them was inhuman and unjustified.

      Even BJP State Observer Sunil Deodhar categorically told media ," Whatever information I have provided to the Union HRD Minister Prakash Javrekar was purely related to the interests of the 10323 teachers' . I just forwarded the details of action take by the state govt in the 10323 issue . I requested him to do the needful in this matter. "

Deodhar further said ," It is really unfortunate that CPI-M is politicalizing the issue blaming me and my party as if we want these teachers to be terminated . The fact is that in the name of reappointing the CPI-M led state govt is once again inviting serious legal crisis that may fall heavily upon the 10323 teachers "

It is to be mentioned here that the State govt did not follow the guidelines given by the Supreme Court of India in its order dated 29/03/2017 . Rather the state govt created some mysterious non-teaching  posts making teaching experience mandatory for all these . Right from the beginning questions have been raised by the legal experts about the validity of such posts . But the state govt seems to behave like ," We make rules and we know everything ." Due to this arrogance the Supreme Court issued returnable notice in a Contempt of Court Case filed by Debashish Pal Chowdhury .

      Now , instead of acting as per the instruction of the SC state govt is heading for a serious gamble with a purely political intention  and this time the state govt is playing with the sentiments of 10323 teachers . As such without facing the reality state govt and Education Minister Tapan Chakraborty have stated acting in such a way as if they are political party and leader, respectively . However, a highly placed source in the State Secretariat told this correspondent ," The way the high officials of Education Department and the Minister himself are holding meetings with legal experts it proves that stategovtis under tremendous pressure after the SCs returnable notice . So much worried is that the statements of the officials( revealed in close corners) and the Minister contradict one another . By now it seems that this govt is once again inviting a big slap on its face from the Supreme Court if it remains arrogant on its stunt with 13000 non-teaching posts. "
