LF Govt's arrogance inviting another legal crisis for 10323 terminated teachers ; SC notice in Contempt of Court case creates earthquake ; Teaching Experience for Non-Teaching posts ? SC to slam again

AGARTALA, Sept 16 (TIWN) : Arrogance of CPI-M party and Left Front Govt led by Manik Sarkar has invited another serious crisis for state Govt as the Supreme Court of India issued returnable notice to the three top officials in a Contempt of Court Case filed by one Debashish Pal Chowdhury . On 11th September the Supreme Court Division Bench comprising Justice Adarsh Kumar Goel and Justice UdayUmeshLalit , on heraing the CONMT.PET(C) No1706/2017 in SLP (C) No 18993-19049/2014 For Admission and IA No 85160/2017(CLARIFICATION/DIRECTION) issued notice to :- 1. Sanjeev Ranjan , IAS , Chief Secretary , Govt of Tripura 2. Sushil Kumar ,IAS , Principal Secretary to the Govt of Tripura, Education Department 3. NirmalAdhikari , Addl Secretary to the Govt of Tripura , Education Department(School). In its order the Division Bench of the Supreme Court categorically said :- " The petition was called for hearing today. Since it is stated that certain steps are being taken in violation of this Court's order dated 29/03/2017 issue notice returnable within two weeks. "

 It is to be mentioned here that in its order in 10323 terminated teachers' jobs  given on 29th March 2017 on hearing against SLP No 21249/2014 in State of Tripura & ORS versus TanmayNath& ORS the Division Bench of the Supreme Court comprising Justice  Adarsh Kumar Goel and UdayUmeshLalitupheld the judgement of the Division Bench of the High Court given on 7th May 2014 . The Supreme Court of India also said that the 10323 terminated teachers can remain in service up to 31st December 2017 . By this time the state govt has to frame fresh Employment Policy and initiate process to recruit them, who have requisite qualifications as specified in the NCTE guidelines .

But the arrogant state govt led by CM Manik Sarkar and Education Minister Tapan Chakraborty violated the Supreme Court's order and initiated to re-appoint the 10323 terminated teachers in Non-Teaching posts without giving any chance to freshers' and even those who applied for these 10323 posts but were not selected . Interestingly , though all these posts are Non-Teaching but the state govt quite unconstitutionally made " Teaching Experience" mandatory for such posts. Thus, the motive is clear that the state govt , in a round about way , wants to reappoint only those 10323 teachers without giving any chance to the candidates who earlier applied or to the freshers .

The state govt on 27th June 2017 created 12,000non-teaching posts in  Education Dept(School) in 5 categories namely :-

 1) Academic Councilor 1200 posts,

2) Student Councilor

 3) School Library Assistant,

 4) ProgrammeAssistant

  5) Hostel Warden

As per service conduct rule an employee can not apply for a lower post and even if it is of a same rank the employee can only apply for it if such is a Feeder Post . But the state govt again created a similar legal crisis like it did in the 10323 teachers' appointment . Now with the Supreme Court granted the Contempt of Court case filed by Debashish Pal Chowdhury once again suspense has been created in School Education Department .

 Meanwhile , a highly placed TIWN sources in the State Secretariat told this correspondent over phone ,"Since Thursday the top officials of the School Education Department have been holding meeting after meeting but no solution is yet to be taken . Indeed, an earthquake like situation now prevails among the top officials to find a suitable solution . "

Though Tapan Chakraborty said that there is no proof that the 12000 non-teaching posts are only for the 10323 terminated teachers , the pertinent question is ," Why aren't the fresher’s not allowed to apply for these ? Why is teaching experience necessary for non-teaching posts ?"
