AGARTALA, September 15 (TIWN) : In a major jolt to CPI-M ruled Tripura Govt led by Chief Minister Manik Sarkar and School Education Department Minister Tapan Chakraborty, the Supreme Court of India has served notice to the Govt of Tripura regarding the violation of SCs order given on 29th March 2017 in the 10323 terminated teachers' jobs . On 11th September the Supreme Court Division Bench comprising Justice Adarsh Kumar Goel and Justice Uday Umesh Lalit , on heraing the CONMT.PET(C) No1706/2017 in SLP (C) No 18993-19049/2014 For Admission and IA No 85160/2017(CLARIFICATION/DIRECTION) issues notice to three top level officials namely :
1) Sanjeev Ranjan , IAS , Chief Secretary , Govt of Tripura
2) Sushil Kumar ,IAS , Principal Secretary to the Govt of Tripura, Education Department
3) Nirmal Adhikari , Addl Secretary to the Govt of Tripura , Education Department(School) .
Supreme Court Notice to Tripura Govt on 10323 Teachers scam
Supreme Court named three top level officials namely :
- Sanjeev Ranjan , IAS , Chief Secretary , Govt of Tripura
- Sushil Kumar ,IAS , Principal Secretary to the Govt of Tripura, Education Department
- Nirmal Adhikari , Addl Secretary to the Govt of Tripura , Education Department(School) .
In its order given on 11/09/2017 the Division Bench of the Supreme Court categorically said :-
" The petition was called for hearing today".
Since it is stated that certain steps are being taken in violation of this Court's order dated 29/03/2017 issue notice returnable within two weeks. "
The petitioners in the case are Debashish Pal Chowdhury & ORS
It is to be mentioned here that in its order in 10323 terminated teachers' jobs given on 29th March 2017 on hearing against SLP No 21249/2014 in State of Tripura & ORS versus Tanmay Nath & ORS the Division Bench of the Supreme Court comprising Justice Adarsh Kumar Goel and Uday Umesh Lalit mentioned the following vital points :-
- New Employment Policy should be framed by the Stateby 30th April 2017 if not already framed and advertisements for filling up the vacancies may be issued latest by 31st May 2017 .
- The fresh selection process be completed on or before 31st December 2017 and till fresh process is completed , the teachers already appointed shall continue
- The candidates, who participated in the selection process pursuant to the advertisements in question, whether selected or not will beallowed to participate in thefresh selection process by relaxing their age but subject to their having necessary qualifications
- The qualifications of teachers employed for Class -IX and above shall be strictly in compliance with the relevant provisions concerning such appointment. But the arrogant state govt led by CM Manik Sarkar and Education Minister Tapan Chakraborty violated the Supreme Court's order and initiated to re-appoint the 10323 terminated teachers in Non-Teaching posts without giving any chance to freshers' and even those who applied for these 10323 posts but were not selected . Interestingly , though all these posts are Non-Teaching but the state govt quite unconstitutionally made " Teaching Experience" mandatory for such posts. Thus, the motive is clear that the state govt , in a round about way , wants to reappoint only those 10323 teachers without giving any chance to the candidates who earlier applied or to the freshers .
Rather the state govt created 12,000 pists in Education Dept(School) in 4 categories namely :-
1) Academic Councilor 1200 posts,
2) Student Councilor
3) School Library Assistant,
4) School Assistant :
5)Academic Counsellor
6) Student Counsellor
7) Hostel Warden (300) with 5 years experience & for School Assistant posts 3 years of teaching experience.
With this notice issued by the Supreme Court of India , once again suspense has created among the 10323 teachers as far as the appointment to teachers in non-teaching posts are concerned.
As per official norms, Supreme Court issued notice to Tripura Chief Secretary but actual target is India's most corrupt scam-master Manik Sarkar who not only created 10323 Teachers recruitment scam but embezzled hundreds of crores Central funds from MGNREGA to NHM, RMSA schemes.
Manik Sarkar's future heading towards prison just like another Chief Minister Om Prakash Chauthala of Haryana who is serving stiff sentence for involvement in similar teachers recruitment scams.
