Supreme Court stays Tripura HC decision against state govt employment policy on 10,323 cancelled teachers' jobs, minister says apex court proved HC encroachment on govt domain

AGARTALA, August 4 (TIWN): The Supreme Court on Monday admitted the Special Leave Petition filed by the Government of Tripura challenging the verdict of the Tripura High Court which cancelled the jobs of 10,323 graduate, under-graduate and post-graduate teachers earlier this year. Even though Govt is rejoicing with this news but the fact is Govt's appeal may get dismissed in Supreme Court at very first hearing scheduled on 12th September. As per legal experts, most likely Supreme Court will stick to the High Court judgement based on the merit of the case and Tripura Govt's momentary joy maybe short lived.

The apex court imposed stay order on the High Court verdict of opposing the state government's recruitment rules and its instruction to recruit candidates into all cancelled posts by the next two months. Reacting to the Supreme Court stand here today, School Education minister Tapan Chakraborty said that the Supreme Court's stand to impose stay order on the High Court's decision on the state's employment policy was positive and encouraging. "The Special Leave Petition was filed with the Supreme Court challenging against the High Court's intervention in the affairs of the state government which we consider as encroachment within the jurisdiction of the state government.

The apex court proved it right by imposing stay order on the HC decision", Chakraborty said. He added that the Supreme Court didn't stay the High Court order to cancel 10,323 teachers' jobs by December 31 this year but fixed the next date of hearing of the case on September 12, 2014.
The Supreme Court division bench comprising of Justice JS Kher and Justice RK Aggarwal said that the apex coury is eager for speedy disposal of the case, a source in the law department said later this afternoon. 

Asked about the government's take on the Supreme Court decision to stay the Tripura High Court decision, school education minister Chakraborty said, "We feel relieved. We are now waiting for the final verdict from the Supreme Court". He added that several stakeholders had tried to dilute the issue in the past few months.  "We at the state government chose to stay silent. We believe and respect the judiciary. We will continue to do so", the minister said.

Three separate Special Leave Petitions were filed with the Supreme Court against the verdict of the Tripura High Court earlier this year. A petition was filed by the group of 58 candidates who appealed to the High Court against the recruitment of Under Graduate Teachers. The second petition was filed by the state government while a third petition was filed by teachers whose jobs stood to be cancelled due to the High Court verdict despite them not being directly a party to the issue.

TIWN spoke to eminent lawyer Arun Kanti Bhowmik - Mr. Bhowmik  informed that this is just a notice issued by Supreme Court as court was closed for past 2 months, first  hearing of case is on 12th September.  Supreme Court didn't cancel or put a stay on 31st December deadline of terminating 10,323 teachers.
