HC verdict : Govt to file petition in Supreme Court

AGARTALA, May 13 (TIWN): Under heavy political pressure, Tripura Govt Legal Team started hectic paperworks to file petition in Supreme Court challenging High Court verdict canceling appointment of 10,323 teachers , who were recruited in service since 2010. Left Front Govt and its political friends in New Delhi approaching many top Supreme Court Lawyers. Also few lawyers close to CPIM Polibureau members also being approached by CPIM party heads and administration. Names are not finalized yet but CPIM and Govt planning to spend crores of rupees in legal fees to put up a brave fight against HC order.

Having burnt the hands on the job issue, the Council of Ministers on May 10th  gave its consent to appeal before the Supreme Court challenging the verdict of High Court of Tripura’s division bench canceling appointment of 10,323 teachers. The Cabinet after exploring all aspects over the HC verdict decided to approach the apex court appealing the review of the verdict canceling the job of 10,323 teachers, according to a highly places sources. Chief Secretary S.K. Panda and Law Secretary DM Jamatia were asked to expedite the process keeping in mind of the gravity of the issue. On May 10th, former Advocate General Bikash Ranjan Bhattacharjee held meeting with Advocate General BC Das and senior government advocate on the ‘historic’ judgment of the HC.

Besides, the party leaders have also discussed the issue on how to save the job of 10,323 teachers. Worried by the judgment, the party had already given its nod for approaching the apex court and  decision was nothing but an official tag on the issue.

On May 7, the division bench of HC headed by Chief Justice Deepak Gupta cancelled the appointment of 10,323 teachers who had appointed since 2010 on the ground that proper procedure was not followed while picking up the candidates.

The court, in its verdict, asked the government to initiate fresh process for appointment of teachers by 31.12. 2014- the cut off date for termination of 10.323 teachers.

Almost all opposition parties- Congress, BJP and Tripura Pragatishil Gramin Congress (TPGC) have welcomed the judgment saying the court did justice to the genuine candidates.

However, the ruling CPM and its frontal organizations like Tripura Employees’ Coordination Committee (HGB) Tripura Govt Teachers’ Association, DYFI and SFI expressed their dismay over the verdict.

Legal luminaries and experts in State and New Delhi viewing State Govt’s. face saving action may backfire because chances of winning this case is bleak in Supreme Court due to lack of legal strength in State Govt’s action. Govt.did not follow  guidelines in recruitment of teachers which resulted in High Court’s  judgement. Some legal experts felt  it was a wrong decision to approach Supreme Court as now top decision makers in Government like Chief Minister, Education Minister, Chief Secretary may be roped into this case by opposition lawyers and a CBI investigation may follow – very similar fate may happen like  Haryana Chief Minister Om Prakash Chautala jailed for 10yrs in Teachers recruitment scam. If CBI investigation ordered by Supreme Court – then certainly it will cost dearly  to Left Front government as CPIM’s Bete noire Narendra Modi  most likely be the next PM.
