AGARTALA, Nov 1 (TIWN): India’s one of the best criminal lawyers, former foreign Minister Salman Khurshid would place the case before the division bench of the Supreme Court on Monday for the final hearing of the case of the PCC president Birajit Sinha. On Monday the case will be produced before the Supreme Court and India’s one of the best criminal defence lawyer Salman Khurshid would produce the case on Sinha’s behalf. It is to be mentioned here that PCC President Birajit Sinha will get relieve if the Apex court grants him bail on November 2 or else the veteran leader will have to spend three months in the jail according to the legal analysts. Reportedly, Tripura Pradesh Congress Committee (TPCC) president Birajit Sinha, who was sentenced to three-month imprisonment term, on Saturday surrendered before a local court at Kailasahar in Unakoti District.Amidst tight security arrangements and in the presence of about more than 300 congress party supporters PCC president Birajit Sinha on Saturday surrendered before of the District and session judge court of Kailsahar. PCC president Birajit Sinha surrendered before the District and session judge court of Kailsahar at sharp 12 in the afternoon under Magistrate Gautam Debnath.
Following the orders of the court, PCC President Birajit Sinha entered the Kailasahar jail at 1.35 PM. The case started on July 20, 2004 when Birajit Sinha, accompanied by his personal security officer (PSO), had gone to Babur Bazar area under Kailasahar subdivision after receiving reports of alleged booth capturing by CPI(M) in Panchayat election that day.
Reportedly, When he reached there Sinha was allegedly encircled by armed CPI(M) cadres ; his PSO had to open fire to save him and a local CPI (M) leader was shot dead but Sinha himself was arrested on several cooked up charges.
Sinha had gone to Babur Bazar carrying his licensed pistol, twelve bullets and five extra bullets. His gun was licensed and he was authorised to carry twelve bullets; so he was charged with carrying five extra bullets in violation of the administrative order for which he was convicted in the district and session court which rejected all other charges.
It is to be mentioned here that The Tripura High Court had upheld a lower court verdict of three months imprisonment to Tripura Congress chief Birajit Sinha in a 2004 case of violation of Indian Arms Act. A division bench of Chief Justice Deepak Gupta and Justice Subhasish Talapatra asked Sinha to surrender before the court within one month from the date of pronouncement of the verdict. DYFI worker Abdul Hannan and Sinhas personal security guard Nikhil Deb had died at Baburbazar at North Tripura district following violence on the day gram panchayat election were held in July 2004. Later Hannans father filed a case against Sinha in the court of the district and sessions judge charging him with the murder. The court in its verdict in November 2013 acquitted Sinha of murder but ordered him to undergo three months imprisonment for violating Indian Arms Act.
