SC stays Birajit Sinha’s 3 months Jail sentence : Birajit’s high profile lawyer Salman Khurshid gets stay order against Tripura HC’s decision, “I do not have to surrender at all”, Birajit Sinha talks to TIWN

AGARTALA, Sep 23 (TIWN): India’s one of the best criminal lawyer, former foreign Minister Salman Khurshid successfully arranged stay order against Tripura High Court’s decision on State Congress President Birajit Sinha, . While talking to TIWN, Sinha said, “At 2 pm my case was produced before the Supreme Court and India’s one of the best criminal defence lawyer Salman Khurshid produced the case on my behalf”.Sinha further said, “I am very happy to get the bail order, now I don’t have to surrender”. However earlier Sinha was unwilling to declare the name of the lawyer, but it is only on Wednesday that Sinha disclosed the name to TIWN correspondent over phone. It’s to be mentioned that Salman Khurshid is an Indian politician and was the Cabinet Minister of the Ministry of External Affairs. He belongs to the Indian National Congress. Earlier Sinha pointed out while talking to TIWN that “Rahul Gandhi and Sonia Gandhi is with me, so I am not afraid”, however, after hearing Sinha seemed very happy with SC’s stay order over High Court’s judgement. Birajit Sinha was accused of violating arms act which caused double murders in the year 2004 during a Panchayat poll in Baburbazar, Kailashahar. Huge fight and firing exchanged among opposition Congress and ruling CPI-M supporters at Babur Bazar area in Northern Tripura on that very day, due to which 2 people lost their lives. One of them was CPI-M leader Abdul Hannan and another was Sinha`s personal security guard Nikhil Deb. Birajit Sinha was a panchayat and rural development minister during that time was carrying a licensed pistol on that day, but Sinha violated Arm’s Act by keeping extra cartridges along with him.

As per rule, a licence holder person can bear only 12 cartridges, but Sinha was carrying in toal 17 cartridges on that day.

Following the incident case had been registered against Birajit Sinha in Unokoti Dist. session Court. Court after few hearings, finally gave its verdict with 3 months jail to Sinha “for carrying extra cartridges”.
 
But CPI-M furthur appealed in Tripura High Court against Sinha alleging that Sinha was also chiefly involved in “double-murder” incident on 2004’s election. However, Tripura High Court on September 7, 2014 withheld the same decision to Sinha which was again 3 month’s jail. However, High Court also declared that Sinha was not involved in any murder.
 
Being unsatisfied with Tripura High Court’s decision Sinha decided to go to the Supreme Court and on September 14 he has appealed in SC to get a “Stay-Order” upon Tripura High Court’s decision. Following this, it’s on September 23 that SC brought stay order on Tripura High Court’s decision.

However, about the next hearing date in SC is not decided yet, added Sinha.
