Birajit files case in Supreme Court on Monday, 'India’s best criminal lawyer is filing my case, surrender is out of question, Rahul and Sonia with me,so I am not scared' : Birajit Sinha talks to TIWN

AGARTALA, Sept 14 (TIWN): Tripura Pradesh Congress President Birajit Sinha seems preparing for a long legal battle in Supreme Court and not prepared to goto jail for 3 months as convicted by High Court for violating Arms Act,. While talking to TIWN on Monday, Sinha boasted, “I have confidence that I would not have to go to jail, as India’s best criminal Lawyer is filing my case in Supreme Court”. However, Sinha doesn’t want to disclose the name of the Lawyer right now and said, “Sonia Gandhi and Rahul Gandhi’s supports are with me, so why should I be afraid?” “I respect Tripura High Court’s decision anyhow, but today my case is filed in India’s topmost Court”. Controversy also has been erupted over Sinha’s long stay at New Delhi due to fear of immediate arrest after HC verdict, also rather than serving Tripura as Congress President, living in Delhi. Moreover, the day when Tripura High Court announced its final verdict, Sinha was at New Delhi. Asking about that Sinha said, “I have not escaped, but I have come here for party related works”. However, within 1 month after the conviction, HC had asked Sinha to surrender and on 21st September, which he might surrender himself, sources says.It’s to be mentioned that Sinha is allegedly involved in double homicide which took place during a gram panchayat by-poll on July 20, 2004. As per rule, a licence holder person can bear only 12 cartridges, but Sinha was carrying in toal 17 cartridges on that day.

Huge fight and firing took place between opposition Congress and ruling CPI-M supporters at Babur Bazar area in Northern Tripura on that very day, due to which 2 people lost their lives.

One of them was CPI-M leader Abdul Hannan and another was Sinha`s personal security guard Nikhil Deb. Birajit Sinha was a panchayat and rural development minister during that time was carrying a licensed pistol on that day, but Sinha violated Arm’s Act by keeping extra cartridges along with him.

Criticizing CPI-M’s “booth rigging” he said CPI-M has failed to prove him as a murderer, and it has proven in HC’s decision. “My sin was venial, but that venial sin caused me huge loss today”, said Sinha to TIWN. “My extra 5 cartridge, which I didn’t notice at all has become my tragic-flaw”, added Sinha. However, Sinha said, lawyer Pijush Biswash had done much for him and now one of India’s best criminal lawyer is beside him and so he has no fear. He also said, if Supreme court gaves the same verdict he will accept it happily as 2/3 months are very less period of one’s life, and added, as he has not proven as a murderer, that is his best achievement said Sinha.

Following the incident case had been registered against Birajit Sinha in Unakoti Dist. session Court. Court after few hearings, finally gave its verdict with 3 months jail to Sinha “for carrying extra cartridges”.

But CPI-M further appealed in Tripura High Court against Sinha alleging that Sinha was also chiefly involved in “double-murder” incident on 2004’s election. However, Tripura High Court on September 7, 2014 gave the same decision to Sinha which was again 3 month’s jail. However, High Court also declared that Sinha was not involved in any murder.

Being unsatisfied with Tripura High Court’s decision Sinha decided to go to the Supreme Court and on Monday he has appealed in SC to get a “Stay-Order” upon Tripura High Court’s decision.
