 Reservation issue: SC points out flaws in the petition filed by state government

AGARTALA, July 15 (TIWN): The Supreme Court pointed out 12 flaws in the petition filed by state government appealing against the judgment on reservation issue. Tripura High Court has directed the government to maintain the 50 per cent reservation restriction in promotion of officers and employees. The order follows petitions filed by general category candidates deprived of promotion in 2011. The court clubbed them to conduct hearing and laid down general principles for the state government in reserving posts for promotion. When the case came up for hearing on July 7, the apex court has pointed out the flaws to Tripura government appointed counsel Gopal Singh. The Apex court asked for immediate rectification of the following flaws:
1. Court fee is deficit by 3020 less (1530 paid), more of court fee is required.
2. Rules to be corrected as new notification in Special leave petition (SLP).
3. Advocate need to clarify why copy Writ petition (WP) 124/12 only is filed. Why copies of two other matters i.e. 189/11 and 109/11 (including main matter) are not filed.
4. Add ‘etc’ to the cause title of the both the parties everywhere.
5. Advocate needs to clarify whether impugned order is interim or final, correct accordingly everywhere. If I/O is interim then name and address of the advocate of the respondents in the courts is to be given.

6.     Copy of judgment/order/notification/award/ annexure/Cos letter dated annexure ref. in the I/O (Page 58 etc) is not filed. (If required)
7.     Col. 2, 3, 4 to be filled properly in L/P.
8.     Petition doesn’t contain statement in terms of order XXI Rule 3(5) SCR 2013.
9.     Whether the annexure referred to in the petition are true copies of the documents before the court below and are filed in chronological order as per list of dates? No
10.  Page 119 twice with different contents in paper books.
11.  Vakalatnama is not executed by all the petitioners.
12.  All the S.C documents are undated.

Now question arises, among the concerned public are the defects maintained in the petition intentionally. If it is committed intentionally what is the mystery behind such blunder. Government counsel Gopal Singh is alleged of putting up a wrong image of the state government in front of the Supreme Court.

A few crores of rupees are being spent behind this case, now however the people are demanding the reason behind such mistakes filed in the writ petition by the Government counsel Gopal Singh.

The prime defects among the 12 found in the writ petition filed by state government lawyer Gopal Singh are mainly the deficit in the court fee. Government counsel Gopal Singh has only paid Rs 1530 and only Writ petition (WP) 124/12 only is filed and the two others were not filed in the petition.

However, now question arises why such negligence is shown by the authority.
