Ganadoot triple murder case: HC finds loopholes in police investigation; Police negligence may lower punishment for mastermind Sushil Chowdhury, next hearing on July 31

AGARTALA, July 10 (TIWN): Tripura High Court on Friday hearing the bail plea of accused mastermind Sushil Chowdhury has found several loopholes in police investigation procedure which has finally sent Chowdhury for life term imprisonment on Ganadoot triple murder case. The next hearing of the case would be held on July 31. The HC under the Division Bench of Chief Justice Deepak Gupta and Justice U. B. Saha on Friday had sought the forensic report and the finger print report of the dagger seized by the police after the incident took place, but interestingly police’s acting of negligence had not sent the dagger for forensic test. Besides, CJ Deepak Gupta hearing the plea of alleged mastermind Sushil Chowdhury had also pointed out that the police had made no effort to conduct healthy investigation. The HC pointing out the loophole of the police investigation and charge sheets had clarified that after the incident took place the police had also made no effort to barricade the incident spot and as a result several clues which might have brought the clear picture of the incident has been lost. HC also pointed out that there is no such relevant statements and clues which finger towards Sushil Chowdhury, who was accused of the mastermind of the case and was sent to life term imprisonment. CJ Deepak Gupta terming the incident to be sensational murder case had mentioned that the finger prints or the forensic report of the seized dagger and also the barricade of the incident spot inside Ganadoot office is very important which would have brought some clear pictures of the incident with the help of which the police could have undertake the investigation in a proper manner.

Defending lawyer Pijush Kanti Biswas on Friday submitted the police charge sheet with the High court following the bail plea of Sushil Chowdhury.

Investigating officer Manas Paul had submitted a 562-page charge sheet accusing Chowdhury of the gruesome incident before the court.

Being asked by the HC CJ Deepak Gupta IO Manas Pal remained present during the hearing of the case on Friday.

The court on Friday pointed out whether the same dagger was used to kill all the three employees of Ganadoot or some more daggers were there which were seized. In reply, lawyer Pijush Kanti Biswas said only one dagger had been seized and according to the police the same was used for the murder of three employees.

HC Division bench also mentioned that police made no effort also to stop the television broadcast of the incident where it was found that the television channels were showing the inside video clips which is not permitted.

However, it is worthy to mention here that from the very beginning controversy erupted with the police investigation which primarily failed to detect the blood tainted shirt of accused mastermind Sushil Chowdhury.

Interestingly, during the investigation procedure of the police it was found that on the day of murder Sushil Chowdhury wearing the same blood tainted shirt was talking to the police official at the Ganadoot Office whereas police failed to spot blood in Sushil’s shirt.

The West Tripura Additional District and Sessions Judge’s Court had sentenced mastermind Sushil Chowdhury to life term imprisonment on July 17 previous year. Later challenging the verdict of the lower court Chowdhury had knocked the door of High Court and sought bail plea. The court had also slapped a fine of Rs. 60, 000 on Sushil Chowdhury.

“This is one of the rarest-of-the-rare cases. Choudhury was the main architect of killing those three people and it was a pre-planned and tactful murder,” Judge Kripankar Chakraborty said in his 434-page judgment.

Three employees of 'Danik Ganadoot', a vernacular daily were killed inside the newspaper office premises at Palace Compound in the heart of the city on May 19, 2013 sending shock waves across the entire state.
