Tripura Govt. acted illegally to evict hawkers, says HC

AGARTALA, June 16 (TIWN): So far the Tripura Left front Government has been found on a spree illegally evicting the hawkers in the capital city Agartala without following the Street Vendors (Protection of Livelihood and Regulation of Street Vending) Act, 2014.

The Tripura High Court on Monday hearing the Public Interest Litigation (PIL) filed by four evicted hawkers has said, “No street vendors or hawkers can be evicted without bringing them under the coverage of survey which was supposed to be carried on by the state government after every five years as per the act.”

Amongst the four hawkers of Agartala the state govt. has issued a notice to two identified as Babul Majumder and another Joshel Miah whereas another two identified as Niranjan Saha and Shyamal Saha were evicted. However, but the court on Monday has finding the illegal act of state government has stayed the notice of two hawkers issued by the government and another two were asked to continue their business.

The four had filed a PIL with the High Court on June 6, 2015 challenging the notice and the act of the state government here.

According to the Street Vendors (Protection of Livelihood and Regulation of Street Vending) Act, 2014, The Town Vending Committee shall, within such period and in such manner as may be specified in the scheme, conduct a survey of all existing street vendors, within the area under its jursidiction, and subsequent survey shall be carried out at least once in every five years.

Besides, No street vendor shall be evicted or, as the case may be, relocated till the survey specified under sub-section (1) has been completed and the certificate of vending is issued to all street vendors.

According to Section 12 of the Act every street vendor shall have the right to carry on the business of street vending activities in accordance with the terms and conditions mentioned in the certificate of vending.

However, for the first of its kind the court on Monday ordered that the state government violating the cat has been found illegally evicted the hawkers of the city. Besides, a section of vendors on Mondayevening welcoming the decision of the court claimed, “We were deprived at large as the state government had acting strict against us has killed our daily source of income.”

“We welcome the decision of the court and we would now stage a stern protest against the state government and its department if further they act barrier to our business,” said the deprived hawkers.
