Hearing of the 10,323 teacher termination case scheduled to be held on July 27; dark cloud still prevails

AGARTALA, April 6 (TIWN): The decision of the finalization of the Court to hear the leave petition of the 10,323 teachers’ termination case was placed at Registrar Court No-2 of Supreme Court of India on Monday. However due to the appeal of the petitioners, the hearing was scheduled on July 27. Talking to TIWN, the Law Secretary Data Mohan Jamatia said that the finalization of the Court would now be decided on the scheduled tentative date.In the mean time, the notice had been sent to the defense parties. After the hearing on January 28, next date of hearing of the 10,323 teacher termination case was scheduled on April 6. After the first hearing in the month of August, the case was again placed in the Court for hearing today. Though no satisfactory result was announced and anxiety still prevails among the 10,323 teachers. Registrar of Supreme Court conducted a preliminary hearing in October this year and admitted the case for further hearing. Till now among 431 persons, 20 or 30 persons have not received the notice. It is to be mention that 500 petitions were submitted at the Court.The Supreme Court in the year 2009 issued a notification that in case of appointment of teachers new education policy should be implemented. As per the notification, Central Government had instructed the State Governments to take this policy in action. But the State Government of Tripura turned a deaf ear to this and still no education policy was implemented.

On the other hand, uncertainty still prevails over the 10,323 teachers’ termination case. The teachers were feeling anxious of their future. Whether the Supreme Court will deliver the judgment in their favour or against is now the top most burning question among the all sections of people. The questions arise in the present moment are:

1) Why did the government take refuge in lies from the very beginning?

2) Has the government gotten hint from legal experts that it would lose the case in the SC?

3) Is the Inter Locator appeal another attempt to fooling the people?

4) If the hearing on Interlocutory Application date is finalized after 31st December what will be the government's step?

5) Is the government worried after it learned that the case will be dealt with Avisekh Many Singbhi and in that case will it be defeat awaiting situation?

It is to be mentioned here that the High Court of Tripura on seventh May issued an order for the termination of services of 10,323 teachers as the State government does not follow the justified process for their selection. After that the Government appealed to the Supreme Court to take proper action in the termination issue of the teachers. On the other hand, a section of the job aspirants among 10,323 teachers will file a criminal case against the State Government. A highly informed source states that, if State Government failed to win the 10,323 teacher termination case in the Supreme Court, most of the teachers will file case against the Government.
