AGARTALA, May 20 (TIWN): Calcutta High Court has ordered the State Govt to clear the pending DA within 3 months, saying it is an enforceable right of the Govt employees. As per the Court’s order the Govt of Bengal now has to pay Dearness Allowance within a month. The Calcutta High Court dismissed the state's plea which stated fund crisis for incapability to pay off the DA. In passing judgment in the case, a division bench of Justice Harish Tandon and Justice Rabindranath Samantar said that DA is workers’ fundamental and legal right. Now the order must be implemented within 3 months.
Speaking on behalf of the plaintiffs, Malay Mukherjee said, "This is not just a victory of the Confederation of State Government Employees, it is a victory of the entire employees community. The High Court today upheld the decision and said that the SAT judgment should be implemented within three months. The DA should be calculated according to the All India Consumer Price Index. We are happy with this verdict.
On behalf of the organization, President Shyamal Mitra said that the DA can no longer be stuck on the argument that there is no fund. The organization has appealed to the Chief Minister of the state, not making it a prestige fight.
This verdict has ushered hopes for Tripura State employees as the verdict stated that DA is a fundamental right of Govt employees and no fund crisis cane be an issue for depriving employees of their benefits.
