Udaipur : Business Association likely to file Writ Petition in High Court against Udaipur Municipal Council's wrongdoings ; UMC under pressure

UDAIPUR, December 29 (TIWN): Udaipur Municipal Council (UMC) is most likely to face legal challenge in the High Court due its Tughluqian decision taken on 20th December. On that day UMC decided that from 21/12/2014 the vacant places inside Lake City Shopping Complex, just opposite of UMC office, will be used as Paid Parking Zone. And even the businessmen having stalls in the Lake City Shopping Complex are to pay for parking their vehicles. On the following day itself the Businessmen's Association of Shopping Complex protested against this Tughluqian decision of the UMC and blocked the main road in front of UMC Office for more than three hours. And under pressure from all corners UMC Chairperson Manika Das ultimately decided that for those having stalls inside Shopping Complex will be allowed to park their vehicles in a selected place free of cost. Accordingly an official team was scheduled to visit the place and locate a free parking place for them. But even out of courtesy no official was sent till date locate the place.Speaking to TIWN a businessman said," We have already filed a writ Petition in the HC against UMC. Within a few days notice will be sent by our lawyer to the UMC. If no satisfactory reply is reached, we will lodge a case in the HC."

After waiting for almost seven days businessmen filed an RTI application to UMC. But the Businenessmen's Asso is all set to lodge a case against UMC's decision in the High Court. 

       It is to be mentioned here that Udaipur Nagar Panchayat constructed ' Lake City Shopping Complex' which was completed on 15.12.2007 with the project cost of Rs 8.75 crore having 178 stalls (financial assistance from Ministry of Urban Employment & Poverty Alleviation). But till date only 101 stalls were allotted among the hawkers leaving 77 stalls un-allotted. Out of 77 stalls 31 are in the Ground Floor, 13 are in the First Floor and 33 stalls are in the Second Floor. In the Annual Technical Inspection Report for the year ended 31 March 2011 it was categorically mentioned, " The average construction cost of one stall was Rs 0.049 crore (Rs 8.75 crore ÷ 178 stalls) and the total cost of 77 vacant stalls was Rs 3.77 crore( Rs 0.049 crore × 77 nos)."

      The Audit also mentioned, " To avoid idle investment before construction , the NP should have obtained/ explored the number of interested persons so as to decide the actual number of stalls in the Commercial Complex.... ... The NP did not take any initiative for allotment of stalls by publishing advertisements in the local news papers. Thus, non allotment of stalls has resulted in idle investment of Rs 3.77crore." This loss occurred only in construction.

      Again the rent of the stalls in the Shopping Complex is as follows:-

 

1) Ground Floor  ............Rs 600/-(per stall)

2) First Floor     ...........Rs 400/-(per stall)

3) Second Floor  ...........Rs 300/-(per stall)

 

     The Security Money per stall is given bellow:-

1) Ground Floor........Rs 2 lakh

2) First Floor   ........Rs 50000/-

3) Second Floor...........Rs 25000/-

    

       Thus, due to non allotment of stalls UMC is suffering the following loses:-

 

Loss In Security Money Per Year

 

1) Ground Floor .......Rs 62 lakh

2) First Floor   .......Rs 6.5 lakh

3) Second Floor........Rs 8.25lakh.

 

Loss in Rent per month

 

1) Ground Floor .......Rs 18600/-

2) First  Floor  .......Rs 5200/-

3) Second Floor ........Rs 9900/-

 

       It is to be mentioned here that Rs 8.75 crore was sanctioned to Udaipur Nagar Panchayat for the construction of Lake City Shopping Complex under Rehabilitation of evicted hawkers project. Businessmen's Asso of Lake City Shopping Complex demands," In spite of issuing such Tughluqian order like Paid Parking Zone inside Shopping Complex area ,Udaipur Municipal Council( formerly Udaipur Nagar Panchayat) must take initiatives to allot the un-allotted stalls among the businessmen. Due to such decision already customers have started avoiding buying products from Shopping Complex. And ultimately the businessmen are suffering."
