10,323 teacher’s fate uncertain: Govt. expecting Interlocutory application hearing next week

AGARTALA, November 21 (TIWN): Trying hard enough to save all the 10323 terminated teachers of Tripura, the state govt. earlier filed an interlocutory application with the Supreme Court of India. And now the state govt. is expecting the hearing next week of this month.Talking to the media persons here at the civil secretariat Education Minister Tapan Chakraborty said that the state govt. had already filed an interlocutory application with the Supreme Court in connection with a special leave petition earlier filed in the apex court challenging a verdict of the High Court of Tripura terminating jobs of 10,323 graduate, post graduate and under graduate teachers, and is now expecting the hearing in next week of this month.State Govt and School Education Department suffered a major setback as Registrar of the Supreme Court declared on Oct 28 that the 'Hearing on the Teachers Recruitment Rules of the state' govt will be held on 9th January 2015 which was declared ' Unconstitutional' on May 7 by the Division Bench of High Court headed by Chief Justice Deepak Kumar Gupta and Justice Swapan Ch Das.

Minister Tapan Chakroborty also said that the state government is very hopeful that the interlocutory application would lead to positive outcomes, even though reality is different. 

However, it is to be mentioned here that the Supreme Court imposed stay order on cancellation of the state government employment policy and its directions to frame new employment policy. The Registrar of Supreme Court of India conducted a preliminary hearing in October this year and admitted the case for further hearing on January 09, 2015.

The Supreme Court didn’t, however, impose any stay order on the High Court order to terminate 10,323 teachers’ jobs for irregularities in the recruitment process.

On Oct 28, the the matter was not raised in the Supreme Court as all the respondents did not get notice from the Supreme Court and the the reply from the respondents did not yet reach to the Registrar. Now after considering all facts the Registrar decided that the Hearing on this matter will be held on 9th January 2015. Now it is clear that the jobs of all 10323 teachers will be automatically terminated after 31st December 2014.

         Speaking on this matter senior advocate Arun Kanti Bhowmik told TIWN," Now there is no doubt that the jobs of 10323 teachers recruited by state govt from 2010 to 2013 will be terminated after  31st December 2014. the Division Bench of the High Court in may gave its verdict that those 10323 teachers can carry on their jobs up to 31st December. In this judgement HC also said that the state govt must declare a new recruitment rules by 31st July 2014 and the vacant posts will have to be filled up under the new recruitment rules. As such you see now no recruitment is being taken place in Tripura."

      Arun Kanti Bhowmik specifically said," State Govt challenged the HC’s judgement in the Supreme Court. Accordingly Supreme Court issued a stay order against the HCs judgement on the declaration of new recruitment rules. But no such stay order was given against the HCs judgement on the termination of 10323 teachers jobs( in its judgement given in May 7 this year). Thus, no doubt should remain about the termination of these jobs." It is to be mentioned here that after the state govt challenged the HCs judgement in the Supreme Court, it was scheduled that the matter would be raised on 12th September, 2014. But due to shortage of time the matter was not even raised.

       However, the Supreme Court Registrar has asked all the petitioners to submit their reply before the Supreme Court with in four weeks. Renowned lawyer of the country Abhisekh Manu Singbhi is the Pradesh Congress appointed lawyer on behalf of the petitioners and unemployed youths who challenged the state govt's appointment of 10323 Post Graduate and Under Graduate teachers. Now several questions that arise from this 10323 teachers termination case are as follows:-

1) Was the state govt informed by the legal experts that 10323 teacher jobs will be terminated as per High Court's judgement?

2) Was the plan to collect money from the terminated teachers by the CPI(M)s employees wings a shrewd plan of Manik Sarkar, the so called Mr White Chief Minister?

3) How much money was raised by the H B Road leaders from the terminated teachers ( it is authenticated by a H B Road leader that Rs 1500/-, Rs 1000/- and Rs 500/- were respectively collected from PGT,GT and UGT)?

4) Did Manik Sarkar reveal his 'inhuman face' through this cruel motive of raising his party fund?

5) Who is he be fooling? To the terminated teachers? Their families? To the whole state?

6) What will be the game plan after the 31st December?

7) Who will be responsible if the situation gets unruly immediately after the termination of 10323 teachers jobs?

8) What will be the future of those party leaders who practically sold a single teacher job at the cost of Rs 2-3 lakhs or even more?

9) Why didn’t Manik Sarkar listen to the advise of the then Advocate General Bikash Ranjan Bhattacharya?

( Whispering is on even among the close circuit in Melarmath that the advocate advised the state govt to of follow HCs instruction from time to time).

Had State Govt followed High Court’s May 7 ruling and declare a new recruitment rules by 31st July 2014, followed by a new recruitment drive to fill these 10323 positions, then it would have saved thousands of teachers families.

But State Govt chose to play a cruel game by denying the chance of employment into 10323 teacher posts, even though egoistic Manik’s Govt well aware of imminent defeat in Supreme Court as advised by Legal experts.
