Exceptional SC/ST Promotion Case: Govt. swindled Rs. 1 crore money from Tribal Welfare Dept to hire top advocates from Supreme Court

AGARTALA, November 19 (TIWN): The exceptional SC/ST promotion case finally started at the larger bench of Tripura High Court. Mr. Permit Singh Patwala, Additional Solicitor General of Supreme Court and Rituraj Biswas acted as the Government lawyers and Smt.Kiran Suri acted as the defence lawyer to fight the case. Though it started today, but the final judgment will be given on November 21st.For exceptional promotion of SC and ST’s, the Government did not hesitate to spend Rs. 1 crore for hiring the experienced and renowned advocates of Supreme Court of India namely Paramjit Singh Patwala, Additional Solicitor General and Rituraj Biswas. Though Govt has experienced Advocate General , experienced lawyers but the Government, especially Chief Minister Manik Sarkar did not have faith on their own lawyers. So, CM personally ordered the officers to hire the advocates to hoist the victory flag. Now the question arises, inspite of having various funds of the Government, why the state government need to cut the money from the needy people’s fund ?

Though the Government claims that the CPIM Government for the people but its not. People in different tribal areas are facing acute crisis of sanitation, water, health and Govt spending but Govt is spending Tribal welfare dept's money for fighting lost legal cases to back up CM's larger than life ego.

Government is not for a particular caste, creed or religion, Government should function for the welfare of people. So, why the Government is showing stepmotherly attitude towards general people. They are doing every possible step only to save only a particular caste or community. But, general category is not only a selected category. It belongs to all.  So, depriving those means depriving all.

Therefore, it comes under the notice that from 1 crore rupees of total amount , initially 24 lakh rupees were swindled from the welfare schemes of the Tribal Welfare Department. 

It‘s sound everywhere, that the Government is not for a particular caste, creed or religion. Government is only for the people. So, why the Government is playing step- motherly attitude towards general people. They are doing every possible step only to save only a particular caste or community. But, general category is not only a selected category. It belongs to all... If the Government would try to establish as humanitarian Government and CM would maintain the Mr. Clean image, then in reality they had to think for securing the future of all, and not a particular one.

Earlier, Tripura Government by violating the rule followed the promotion process of employees and officers according to their political manipulations. It is also seen that 80 percent employees belonging to Scheduled caste and scheduled tribes are occupying the top most positions in the administration. Inspite of their reservation method, by faulty merit list, they sometimes occupy the position in the general category also.

For example, in the 13th January 2014, 12 candidates are selected in the Secretariat for the gradation from the grade-IV category officers to Grade-III (Group-B, Gazette) officers. According to the reservation policy, 6 officers should be from Scheduled Caste and Scheduled Tribes category. But most astonishingly, 3 candidates were SC category and 8 from ST that means the reservation for general is only 1. Not only this, on 10th October, the administration had notified that promotion should be done in 5 (Grade-I (B) and Grade-I (A) post. Out of them 3 were allotted for general category. But when the circular was published, it is seen that all of the 5 post belong to the SC and ST.

Not only in Secretariat, but in the Tripura Civil Service, Tripura Judicial Service and other top most position, the Government is following their own procedure. They sometimes allotted the SC and ST Candidates in the general posts also, which is completely illegal. That resulted a mere 20 percentage allotment of general categorypeople for promotion.

In order to protest against this, the general category officers and employees organization, namely General Officers and Employees Welfare Society had filed a case in the Guwahati High Court. Inspite of that some TPS, TCS, TGS and IAS Officers had also filed case separately. The then division bench of Guwahati High Court had put a stay order in the up gradation process in the year 2012. But, the State Government had turned a deaf ear to this and continues as earlier. In the meantime the Supreme Court had cancelled the reservation method in promotions on 13-09-2013. It is to be mentioned here that, the reservation method was already cancelled in many states except Tripura and Himachal Pradesh. But the Himachal Pradesh Government had also cancelled this method in the year 2013. That means reservation policy still now exists only in Tripura.

In view of this, the High Court of Tripura had allotted time for hearing by collaborating all the issues of promotion . From 19th-21st November, a division bench consists of four judges will meet to discuss the whole issue. Most probably this is the first time in the history of India that altogether four judges will take decision together. Chief Minister Manik Sarkar had already instructed the Officers to hoist the victory flag by hook or crook. If necessary, CM had instructed to hire advocates from Supreme Court. Now the question arises whether the Government had enough money to hire advocates from Supreme Court or other illegal measures also adopted ?

Tripura is the only state in country where reserved category people are selected for 80% of departmental promotions and a mere 20% promotions are alloted to general category.
