UDAIPUR,November 11 (TIWN): Within one year of a brutal rape, District & Session Judge Asish Pal today sentenced 20 years life imprisonment to three rapists ,who are involved in raping a minor girl of 12 years of Tuiharchung Maharani. The rapists are Hriday Jamatia ,S/O- Kanistha Jamatia, Surya Mohan Jamatia, S/O- Ratibhakta and Karna Sadhan Jamatia, S/O- Karnapada of Krishnabhakta Para of Maharani. On 2nd November 2013 at around 5pm a minor girl of Tuiharchaung area was going to a nearby market alongwith her two friends. But when they came near the Anganwadi Centre, 3 culprits Hriday, Surya mohan and Karna Sadhan forcibly took the girl to a nearby jungle and brutally gang raped her and left her wounded near her house to die. Her friends somehow managed to escape from the hyenas. After this the victim told everything to her mother and two other friends too told about the incident.

On the same night   the victim's mother Rajkumari Jamatia lodged FIR (Case no 134/2013) under Section 341/376(D) and 4 of the Protection of Children from Sexual Offence Act 2012 in the Woman Police Station and  police arrested all the three rapists after chasing them to Delhi and Chennai. Investigating officer Madhabi Debbarma submitted the charge sheet against the three rapists. After hearing the argument from both sides and recording the statement of 12 witnesses District & Session Judge Ashis Pal sentenced Hriday,Suryamohan and Karnasadhan 20 years imprisonment under 376(D) of IPC along with Rs 10000/- penalty or 6 months more imprisonment if unpaid. 

The I/O of the case was Madhabi Debbarma and PP Biplab Kanti Datta was the prosecution lawyer on behalf of the Govt. This is probably one of the biggest sentences in such cases across the Tripura. All the sentences will be in effect simultaneously.

Immediately after the crime all the accused persons absconded to Delhi and from there to Chennai. During investigation IO tracked the APs through mobile data and detained three of them at Chennai and brought then to Udaipur after great difficulty. IO collected all sorts of scientific evidence against the APs. After investigation I.O of the case W/SI Madhabi Debbarma, O/C Udaipur Woman PS, submitted Charge Sheet vide UDP. Woman PS C/S No. 03/2014 dated-21-01-2014 U/S- 341/376(2) (D)/506 IPC and U/S- 4 & 5 (g) of the POCSOA Act- 2012, against those accused of the case.

The Ld. Trial Court on appreciation of evidence found those 3(three) accused quilty u/s 376(D) IPC (for committing gang rape)  and sentence each of them to suffer rigorous imprisonment for 20(twenty) years and to pay fine of Rs.10,000/- for the above mentioned offence.
