Long waits for verdict in Badal Choudhury case continues, Excess Security blanket at CPI-M HQ raise concerns about State Govt’s Intentions

AGARTALA, Oct 16 (TIWN): Since 3.30 pm waiting for verdict in former PWD Minister Badal Chouhdury’s case going on but till now no hearing even after crossing 9.20 PM. Badal Choudhury is right now in interim bail and today it was the second hearing, whereas Badal Choudhury’s Adv Arindam Bhattacharjee sounded confident about the hearing procedure and repeated that there is no ground in this case. Breathless situation across the state to know the final judgement whether Badal Choudhury will get bail or to be arrested. On the other side, BJP Law Minister Ratanlal Nath calling a press conference called Badal Choudhury a “criminal” subjected to 10 years jail.

Eminent Lawyer Purushottom Roy Barman condemned the press conference in a BJP party office by Law Minister used as a tool to malign Badal Choudhury's image according to his wishes on baseless ground. Whole day police and securities have gheraoed CPI-M Party office. The pending hearing in former PWD former Badal Choudhury’s case was pronounced although verdict is delayed, after FIR was lodged against him on 13th October, 2019 at the West Agartala PS. District Court gave him interim bail, instructed a bail bond of Rs. 3 lakhs, whereas in an irony police officer who was appointed as the I/O escaped from police station when Badal Choudhury with his lawyers went to the West Agartala Police Station to submit bail-bond. 

Police have committed various illegal activities in last 48 hours including rejecting bail bond of Badal Choudhury, SP’s direct interference in the court procedure who was seen talking to the PP entering court premise and the ultimate illegal entrance of Police led by Executive Magistrate Rinku Reang in the Melarmath Party Headquarter of CPI-M without search warrant.

The raid for Badal Choudhury was done when District Court ordered not to arrest Badal Choudhury till the hearing ends (Oct 14) but before the hearing came which permitted interim bail for Badal Choudhury, all of a sudden huge numbers of police personnel covered the party office and stopped the entrance. The reason for the raid could not be known on that time but suddenly media persons were informed about the raid and rushed at the CPI-M party headquarter.

Police even did not inform the CPI-M members why they are raiding, but later Gautam Das informed that police were raiding in search of Badal Choudhury led by 1) Executive Magistrate Rinku Reang, 2) SDPO Anirban Das, 3) SDPO Druva Nath.

After Police’s raid senior advocate Purushottom Roy Barman said, “Have you seen police’s activeness in this illegal activity ? Ofcourse the judge ordered before the Public Prosecutor not to arrest Badal Choudhury till 5 PM till the final hearing is pronounced. Still Police have done this, thus, police have violated court’s order. Police simply have thrown challenge to the court. Whoever are involved in this illegal raid, action likely against them in coming days.

In evening a mass rally was organised in Agartala town led by former CM Manik Sarkar against the  BJP Govt led Politically motivated charges and Police FIR against former PWD Minister Badal Choudhury.

After court allowed interim bail for Badal Choudhury, the Police have reportedly committed ultimate crime by not accepting bail bonds of former PWD Minister Badal Choudhury today night. Advocate Arindam Bhattacherjee said that for hours the I/O made them seated, but at least no bail bond was accepted, which is totally a violation of law and contempt of court.Bhattacharya said, “It was almost that we came to surrender in the police station but violating court’s order Badal Choudhury’s bond was denied. Now let’s see till where it goes”.It can be mentioned here that after day long hearing, the West District Court has postponed the final order till 16th October but in a relief for former PWD Minister Badal Choudhury, court has accepted interim bail at the bond of Rs. 3 lakhs, but the I/O denied the bail.

This interim bail is known as a temporary bail for a period in which higher court can call documents required to make a final decision on the bail application in which court can either grant permanent bail, extent interim bail or even can reject bail application.

Also throughout the day, lots of dramas the state has witnesses and reportedly police without court’s order was running from South Tripura to Agartala to Airport in search of the former PWD Minister Badal Choudhury to arrest.

However, such naked attacks of police were seen earlier also with countless people but this time it was with a top opposition leader which has exposed the ruling Govt’s unconstitutional attitudes with the opposition voice.
