AGARTALA, May 4 (TIWN): TIWN's massive victory against Tripura Police's illegal attempts to shut down tripurainfoway portal & Facebook page as CJM court( Case Number 2019 WAG 084) rejected Biplab Deb's Police's illegal case against tripurainfoay.com Editor. In a landmark verdict, a lesson to Tripura’s corrupt police machinery CJM Court, West District has rubbished West Agartala Police’s illegal plea of blocking Tripurainfoway Facebook Page under the case number 2019 WAG 084 and reminded Police of misusing IT Act 69A in out of Jurisdiction Court. TIWN Editor was represented by High Court Lawyers Arindam Bhattacharjee, Raghunath Mukharjee in court today.. In a major embarrassment to Police I/O Subrata Chakraborty, CJM Court has also asked the details regarding the investigation whereas no ‘Criminal Offence’ could be proved by police has been committed by TIWN. TIWN earlier reported, under Biplab Deb's instruction, one BJP party's Fensedyl Smuggler Sunit Sarkar, right hand of BJP MP candidate Pratima Bhowmik had filed various fabricated cases against TIWN and its Editor including extortion case.

Chief Judicial Magistrate S. Mukherjee in a historical verdict has rejected all the fabricated allegation brought to suffocate the freedom of media by police on the basis of fake complaints.

CJM Justice S.Mukherjee reminded Tripura Govt's Assistant Public Prosecutor that there is no provision in CrPC to block a facebook account or website as this is handled by IT Act 69A and no proof of any offence committed. 

 Tripura  Police also wanted to drag TIWN Editor Saumen Sarkar in the court with the sole intention of harassment, which is however not necessary now as Judiciary sent clear warning signal to Tripura Police of misusing IT Act.

CJM's order also termed blocking of facebook page, website is out of Jurisdiction of CrPC as per IT Act 69A.  Police & Public Prosecutor were willfully misusing IT Act 69A in CJM Court to harass tripurainfoway.com Editor.

On Govt side APP Bidyut represented, but based on the appeal by TIWN's Advocate Arindam Bhattacharjee, the IO of the case who failed to prove TIWN-Facebook page committed any offence, may be asked to furnish the report.

TIWN Editor Saumen Sarkar said, “This is the biggest lesson for the undemocratic BJP Govt ,when crisis situation has gripped the state, netizens, journalist are thoroughly arrested just for sharing news or liking news”.

This politically motivated case was filed by RSS and BJP’s activist  cum Fensedyl Smuggler Sunit Sarkar after TIWN along with national media filed a news on Tripura CM’s divorce controversy.

However, before this case, another separate case by the same person was filed to block USA controlled Tripurainfoway.com website which erupted controversy, exposed by the editor on yesterday night during a talk show.

Saumen Sarkar said, “Instead of filing case against media houses and filing defamation case by CM Biplab Deb himself via some smugglers like Sunit Sarkar, Biplab Deb has filed case which are totally fabricated and will not be stable. First of all neither Biplab Deb and his wife Niti Deb till day haven’t filed any case against me and all fabricated cases like blocking of website, extortion were filed. What surprising is that the day BJP filed a case against me, on the next day OC-Subrata Chakraborty rushed to the court and then Judicial Magistrate fMitra Das without following the law and justice system, without notifying the opposition party, Judge Mitra Das issued verdict of blocking website. I want to tell Mrs Mitra Das that I have filed complaint to Chief Justice of India already and will take legal action further. With that report, on that very day the Dept of Telecommunication sent letter to the domain in America to block Tripurainfoway but American authorities rejected this illegal request but sadly for Biplab Deb, the domain has marked Govt of India’s intrigue as “attack on media”.

 TIWN Editor's other legal cases are being handled by Advocate Bhaskar Debbarma, all cases are politically motivated by Biplab Deb's criminal coterie to shut down media.

CJM Justice Sharmistha Mukharjee’s today's verdict also signaled that lower court Justice Mitra Das's April 27,2019 ex-party order has violated the law by hearing a FAKE case by Tripura Police which judgement itself was out of Jurisdiction.
