AGARTALA, November 21 (TIWN): Word mistake may lead the Government to face the contempt of Court. In this connection the Hon’ble High Court of Tripura has ordered Law Secretary and Deputy Law Secretary of the Government of Tripura to remain present in the High Court on Friday. In the Second Session on Thursday evening in the hearing of the Reservation in Promotion, Appellant lawyer B.B.Das had sorted out that there was a printing mistake in the previous order issued by the then Guwahati High Court, Agartala Division Bench in relation to the recent case. Immidiately it had caught the attention of Chief Justice Deepak Gupta and suddenly became angry .Accordingly the Hon’ble Chief Justice said that it may directly relate to the of Contempt of Court. After this Justice Gupta had ordered the Law Secretary and Additional Law Secretary to remain present before the Court on Friday,
It is to be mentioned here that on June 20th of 2012, the then Division Bench of Guwahati High Court led by Justice Ansari and S.C.Das issued a Stay Order on the Rule 9(2) against the Reservation in Promotion vide case No. NP(C) 124 of 2012. But the order had carried a printing mistake. The word “ Act “ had been spelled instead of “Rule.”
When the order was received by SC/ST Social welfare Department, it had sent it to the Law Department for clarification. After that the then Law Secretary ignored the order of the Hon’ble Court, nor the Department had sent it to the Court for further clarification. Accordingly, the State Government started following their own policy for the Reservation in Promotion category.
