10323 teachers termination case : Will Govt save its face after organized lies over SC ruling? Is more political manipulations on the cards?

AGARTALA, November 15 (TIWN): After the continuous attempts of lies from state govt and CPI(M) party lesders since July over the ruling on 10323 teachers termination case , state govt is indeed on back foot. Registrar of Supreme Court on 27th October declared that the case would be raised in the Supreme Court for Hearing on 9th January 2015. But after the declaration of the School Education minister Tapan Chakraborty remarked that state govt will file an ' Interlocutory Appeal' to the Supreme Court demanding a 'Stay order' against the Division bench's ruling that 10323 teachers jobs will be terminated after 31st December 2014. It is learnt from a highly placed sources in the state Secretariate that the ' Interlocutory' appeal will be submitted before the Supreme Court either on 24th November or a few days later. From the statement of School Education Minister Tapan Chakraborty it is clear that state govt was lying to the jobs holders as well as their families and the people of the entire state.

The Supreme Court on 27th October did not say anything in this case. Even the matter was not at all raised in the SC for hearing. Rather the date of hearing was decided by the Registrar. And the next hearing is on 9th January, 2015 i.e., after the termination date as per the ruling of the Division bench of the High Court comprising Chief Justice Deepak Kumar Gupta and Justice S C Das.

Immediately state govt decided that it will submit an Interlocatory Appeal before the SC to give a stay order to the HCs judgement regarding termination of 10323 teachers jobs after 31st December 2014.  In this regard, TIWN tried to talk with the Law Secretary Data Mohan Jamtia over phone but he did not receive the calls. The questions that come out from this new step of state govt are :

1) Why did the govt take refuge in lies from the very beginning( September )?

2) Why has not Tapan Chakraborty made his and state govt's stand clear on this sensitive issue?

3) Whether the officials of state govt have been instructed not to utter a single word in that case as ' the matter is subjudiced'?

4) Has the govt got hint from legal experts that it will lose the case in the SC?

5) Is the Interlocutory Appeal another attempt to befool the people?

6) If the hearing on Interlocutory Appeal date too is finalized after 31st December  what will be the govt's step?

7) Is the govt worried after it learnt that the case wil be dealt by Avishek Manu Singvi and in that case will it be a defeat awaiting situation?

     Now even the fortunate job seekers too have realized that the Supreme Court has issued a stay order only on the govt's recruitment policy, that was declared unconstitutional by the Division bench of Deepak Kumar Gupta and S C Das. They have now also realized that by the name of challenging the case in the SC , CPI(M)'s employees wings rather raised the party fund with Rs 10 crore by collecting donations(?) from those who jobs were terminated and other employees. . All are scared that if the Supreme Court says that the HCs judgement will remain unchanged, there will be serious breakdown in the law and order situation.

     But how shamelessly even at this time of utter mental crisis as far as the 10323 teachers are concerned, state govt employees association of CPI(M) took this situation as a great chance to increase the party fund. It has been authenticated by many of the terminated teachers," Each one of us has been compelled to give atleast  Rs 1500/-(for PGT) ,Rs 1000/-(for GT) and Rs 500/- (for UGT) respectively and many even had to give Rs 2500/- to Rs 3000/- ." And with the recent developments CPI(M) is trying its best not to give the terminated teachers any chance to form a united association. Interestingly the party actually wants that the case is run for a long time. Recently Tapan Chakraborty too has made the remark," Once we get a stay order on termination order , there won't be any problem even if the final verdict is given after three or fours years." These words are the clear indication that state govt wants to play ' buying time' game purely with political interests.
