10,323 teachers’ termination case: Uncertainty still prevails: Govt. to file Interlocutory Application to SC

AGARTALA, October 29 (TIWN): Uncertainty prevails over the fate of 10,323 teachers’ termination case. At the time of first sitting regarding the judgement of High Court, to Supreme Court, Government had appealed to the Court to also put a stay order in the service of these teachers. So that the employment of these teachers not terminated as per Tripura High Court order on May 7. In response, Supreme Court mentioned that the case likely to be scheduled for hearing before the tentative termination date scheduled by the High Court of Tripura i.e December 31, 2014. Now, as the situation had changed and first hearing moved to January 9, 2015, therefore, in order to save the jobs of 10,323 teachers, Government will be filing interlocutory application to the Supreme Court.Speaking to the reporters, Education Minister, Tapan Chakraborty said that, at first the Government thought that, a SC stay order on the High Court Judgement should also save the tenure of service of these teachers. But as this did not work out so as a substitute measure, finally the Government going to file interlocutory application to the Supreme Court.

If the Honourable Court accepts and puts a stay order, then the services will continue. Otherwise, it will put an end on the tenure of the service.

It is to be mentioned here that, the High Court had passed a judgement  mentioning the termination of the 10,323 teachers. In view of these, Government had also filed a case to save the fate of these teachers. In the first sitting, Court had decided to put a stay order in the employment policy and the guidelines of the High Court. But no stay order had been put on the tenure of the service.

Supreme Court also declared earlier the next date of sitting on 25th September. But due to shortage of time, this was not possible. Again the date was declared as 27th October. But repetation occurs. This time the matter was not raised in the Supreme Court as all the respondents did not get notice from the Supreme Court and the reply from the respondents did not yet reach to the Registrar. Now after considering all facts the Registrar decided that the Hearing on this matter will be held on 9th January 2015.

On the other hand, the Supreme Court Registrar has asked all the petitioners to submit their reply before the Supreme Court within four weeks. Renowned lawyer of the country Abhisekh Manu Singbhi is the Pradesh Congress appointed lawyer on behalf of the petitioners and unemployed youths who challenged the state govt's appointment.

However Tapan Chakraborty has no answer why Govt did this grave crime with 10323 teachers lives by recruiting  them illegally which High Court cancelled ?  Had Tripura Govt followed HC's May 7 order, then all those 10323 posts would have been refilled by deserving youths.
