NEW DELHI / AGARTALA, May 14 (TIWN): Supreme Court of India has suggested Left Parties to file re-poll related case in Tripura High Court first instead of directly filing at the Supreme Court. According to the suggestion of the Supreme Court, tomorrow the case will be filed by the MP in the High Court. In a press note, CPI-M state committee member Haripada Das said, “Today the petition filed by MP Sankar Prasad Dutta demanding total re-poll was heard in the Supreme Court. Justice Indira Banerjee and Sanjib Khanna heard the petition. P V Dinesh, advocate of MP Sankar Prasad Dutta told the court that the Election Commission document itself talks about the massive rigging on 11th April. Justices have asked the petitioner first to file in the High Court at first. Thus Sankar Prasad Dutta has withdrawn the petition at Supreme Court and tomorrow to be filed in the High Court”, said CPI-M in a statement.Earlier, Supreme Court had rejected Tripura Left Parties plea of “urgent hearing” regarding the Total Repoll demand in its West Tripura constituency which was rigged massively on 11th April allegedly by ruling BJP.

Chief Justice of India Tanjan Gogoi on May 9 had declared, this case will go in regular process and there is no reason for any urgent hearing and time is still in hand. 

But today the case itself had to be withdrawn to file in High Court.

CPI-M's sitting MP of the West Tripura constituency Sankar Prasad Dutta had filed a petition in the Supreme Court on May 8 afternoon demanding Supreme Court’s interference in Election Commission’s decision about re-polling in only 168 booths, whereas more than 50% booths were rigged leaving strong evidences. 

In the recent press conference regarding the poll-rigging, CPI-M’s veteran leader Bijan Dhar said, "We will continue our protest and strives for re-poll in the total West Tripura constituency and also will be battling in Supreme Court for common men's voting rights, which has been snatched by the BJP in Tripura".

CPI-M's State General Secretary Gautam Das said, repolling in 168 booths (10%) is itself a rarest example in the whole country and for that it is the ruling BJP which is responsible. 

The CPI-M leaders said even though ECI has declared very minimum seat numbers for re-poll but still BJP’s real face has been exposed before the country as ECI decision was taken due to poll-violence and rigging.
