TPSC delaying result of High Court scrutinized 65 Lecturers posts for Technical Institutions : Job aspirants to appeal High Court if recruitment Cancelled

AGARTALA, Aug 20 (TIWN): Tripura Public Service Commission (TPSC) is neither clarifying whether High Court monitored job recruitment processes have been decided to cancel or not, nor it is publishing the pending results, erupting tension among a major section of job aspirants. In a such a strange situation, 190 Technical Institutions job aspirants have met press on Monday at Agartala Press Club after they failed to meet the Higher authorities. The recruitment process had started from 2016 and it was in 2018, June 26 that High Court after scrutinizing the whole recruitment process, had given the final verdict which says the recruitment should be continued according to 29.11.2007's notification. But even after High Court's order the TPSC is not proceeding the recruitment after 2 months of the verdict. Thus, the job aspirants have left a message for the State Govt not to disobey the order of High Court and if "Cancellation" is just a rumour then to hurry up the recruitment as it's already delayed.

The job aspirants said, if the Govt is thinking to cancel High Court monitored jobs, then will it not be appropriate to say that Govt doesn't have faith on the High Court ?? Then what message people will get from the Govt ? They also added that "Cancelling of the Recruitment Procedure comes under Civil-Contempt of Court, Sec-2(b), Act of 1971". 

The job aspirants further said, "Education Minister (Ratan Lal Nath) has expressed his worries about the student-less conditions of Diploma Colleges, but how students will come unless and until qualified teachers will be appointed ? All the colleges are running by contractual and guest lecturers. So if the recruitment is hurried up, then it will help the Govt too to uplift the quality education".

The datails about the High Court monitored recruitment is below :

1) The advertizement No. 05 / 2016 for the post of Lecturer, Diploma Level Technical Institutions in Tripura, Group-A Gazzetted under the Education (Higher) Department, Govt of Tripura, was published by the TPSC on May 2016 and total posts were 65. A total 180 candidates could clear the screening exam and they were called for the interview which was conducted between November to December 2017.

2) One of the candidates challenged the recruitment procedure and urged the High Court to interfere in the said selection process and also for quashing the memorandum No-F.9(40)/Con/Exam/TPSC/2016-1629 dated 30.03.2017 issued by the respondent No-2(Chairman of TPSC) (Annexure-7 to the writ petition) and directing the respondents to reallocate of the percentage of the marks for viva-voce test for the selection in the post of Lecturer, Diploma Level, Technical Institutions, Govt of Tripura. (Collected from the verdict by High Court case no-1404/2017 WP (C).

3) On the first hearing dated 10.11.2017 of the case, the High Court restrained TPSC from publishing the outcome of the selection without permission from the court. The Court said in the hearing, "In the meanwhile, the respondents No-2 (Chairman of TPSC) & 3(Secretary of TPSC) are restrained from publishing the outcome of the selection process without permission from the court". 

4) On the 6th hearing dated 29.01.2018, the High Court stated, "Mr. P Datta, learned counsel appreaing for the TPSC respondents shall produce the records of the viva voce/interview for inspection of the court how the marks of the screening test has been carried for determination of merit and how the academic qualification has been assessed or what was the element or aspects that regulated viva/interview". (The Whole Recruitment process was scrutinized). 

5) On 29.06.2018 the High Court has given the final verdict after hearing the case which says "In view of what has been observed and what has been found from the records produced that the TPSC-respondents followed the procedure as engrafted in clause-2 of the said memorandum dated 30.03.2017. They shall as consequence of the observation above, revisit their recommendation by cancelling what they have made up and thereafter shall make the necessary recommendation by following the notification dated 29.11.2017 for the post of Lecturer, Diploma Level in the Technical Institutions in Tripura".

Thus it is evident that High Court has found the recruitment process fair and directed to make the recommendation. Now if the Govt cancels the procedure, it will fall under civil contempt of court, sec 2 (b), Act of 1971. 

(Notification of 29.11.2007 says, "In order to bring transperncy in selection process and due to introduction of OMR system, it's decided by the commission that henceforth in case of non-scheduled examination the final selection will be made in order of merit on the basis of the marks obtained by a candidate in aggregateadding the mark obtained in the screening test when the selection process will be made on the basis of screening test followed by interview. This is for information to all concerned (Quoted from the verdict). 

The job aspirants further said, "It has been around 2 years that this recruitment process was hanging up.... we don't to go again in the High Court which will delay the issue further".
